Abstract

"... habent sua fata libelli": Nowadays this saying is usually used to state, that a text is only able to impart as much message, as the reader is willing to understand. However, we can make use of this saying in another sense too - for instance just as James Joyce used to say: to give a "book in print a life of its own"; meaning that the fate of a book is above all built on the fact, that it was put into the world. Of course there are papers, which never caught sight of the world, or which later got lost - for example due to a fire-disaster. On the 15th of July 1927, the most important files about the history of the making of Austria's General Civil Code sustained such a fate, due to the fire-disaster in the Viennese Palace of Justice, where these documents have been treasured at the Archive of the Ministry of Justice. This destruction, however, did not lead to the total loss of legal sources relevant to the legal history of Austria's General Civil Code. The most important documents regarding the beginning of the composition of the Austrian General Civil Code have been preserved by Harrasowksy in his edition of the Codex Theresianus in 1883/86. Nevertheless some of the eldest materials, that have been marking the very beginning of the composition of the Codex Theresianus in 1753, composed by the first law-making commission, the so called Compilating-Commission, remained disregarded and untouched in the archives: to begin with, this is a "plan", drawn up by Josef Azzoni in May 1753, containing not only a disposition of the content of the Codex Theresianus, but also a first description of it. Therefore this "plan" can be seen just as a preliminary draft of the project of the Codex Theresianus. Moreover this is a series of descriptions about civil laws, valid for different hereditary provinces of the Habsburg Monarchy, which should then serve as basic sources in regard of the project of an unified Civil Code, which was provided as a common law for the entire monarchy instead of particular laws in different provinces. In his edition of the Codex Theresianus Harrasowsky specified only the headlines of Azzonis "plan"; he also presented several descriptions of the Civil Law, valid for the particular hereditary provinces, namely in annotations to the content of the Codex; however only regarding details, and sporadically distributed within the three parts of the Codex. Since the times of Harrasowsky, legal historical research has not been interested in these eldest materials about the history of the Austrian General Civil Code. Only since World Word II literature in legal history is showing a few references to these materials, of course not in a comprehensive matter or in regard of specific questions dealing with certain contents of specific text modules. Among all these materials only the description of Holger remained entirely in the archive of the Ministry of Justice. About 75 % of these documents treasured in this archive, were completely destroyed due to the fire-disaster in 1927 - as just mentioned at the begin of this lecture. A considerable part of records and files of course was salvaged, but partly seriously damaged by fire and water. Among the eldest preparatory works on the Codex Theresianus - except of Holgers illustration of the contemporary Austrian law - furthermore only Azzonis preliminary draft was kept in existence. Not to mention that both documents are showing remarkable marks of the disaster of 1927, nevertheless these damages are not extensive, and this was leading to the allowance of Austrian Archive of Administration, where these documents are actually preserved, to use them for the purpose of an edition.

Abstract

Amicus curiae participation in international courts is steadily growing since the late 1990 despite lack of clarity on the concept’s nature, function and utility in international dispute settlement. Does amicus curiae infuse international judicial proceedings with alternative views, including the public interest in a case, as often advocated by NGOs? Does it increase the legitimacy and transparency of international dispute settlement, or the coherence of international law? Or is it an unhelpful impostor that impedes negotiated solutions and derails the proceedings at the expense of the parties to advance its own agenda? By way of an empirical-comparative analysis of the laws and practices of the ICJ, the ITLOS, the ECtHR, the IACtHR, the IACtHPR, WTO panels and the Appellate Body, and investment arbitration the dissertation examines the status quo of amicus curiae before international courts and tribunals to determine if the current amicus curiae practice is of added value to international proceedings and international dispute settlement in general. The dissertation shows that there is no common concept of international amicus curiae, but that amicus curiae before the international courts examined share a few characteristics. A proposed functional systematization highlights overlaps and diverging uses of the concept before international courts and helps scholars and practitioners to assess the opportunities and limits of the concept. Analysis of the concept’s current regulatory framework and its substantive effectiveness reveals a hesitation in particular by courts with a strong adversarial tradition to take into account the views of a non-party despite the positive experience with the concept in regional human rights courts. The dissertation concludes that neither the expectations nor the concerns attached to amicus curiae participation in international proceedings have materialized. It argues that the concept can contribute to improved decisions and decision-making in international dispute settlement if regulated and used properly. Seit Ende der 90er Jahre wächst die Teilnahme von amici curiae in Verfahren vor internationalen Gerichten und Schiedsgerichten, obwohl Umfang, Funktion und Mehrwert des amicus curiae und die Folgen seiner Einbindung für Verfahren und die internationale Streitbeilegung kaum untersucht worden sind. Dieses Werk unternimmt eine umfassende empirische Bestandsaufnahme des Instruments in der völkerrechtlichen Streitbeilegung. Es definiert und ordnet das Instrument ein in das Völkerprozessrecht. Darüber hinaus prüft die Arbeit, ob die Teilnahme von amici curiae von Nutzen oder Schaden ist für Verfahren und inzident für die internationale Streitbeilegung insbesondere, ob amicus curiae Schriftsätze in Urteilen Berücksichtigung finden, und ob amici curiae effiziente Vertreter öffentlicher Interessen sind, die Legitimität und Transparenz internationaler Gerichte und ihrer Urteile erhöhen, und die Kohärenz der Völkerrechts stärken.

Abstract

Should court officers cause damage to third parties in performance of their duties, these damages are often claimed as public law cases in which the responsibilities are transferred to the state. The liability of public authorities according to § 839 section 1 sentence 1 German Civil Code in conjunction with Art. 34 sentence 1 German Basic Law is part of state liability law. However, public liability law is a Janus-faced area of legal material. Systematically, it belongs to administrative law, and by that to public law. Nonetheless, a government liability suit is a civil courts domain. When it comes to public liability suits, there are many intrinsic issues arising from special rules of civil courts jurisdiction in these matters. The examination at hand enlightens - by no means exhaustive - questions prior to public liability cases and specific problem constellations in matters of admissibility and merits of legal action for public liability claims.

Abstract

Das Phänomen des Mißbrauchs von Amtsbefugnissen ist in sämtlichen Gesellschaften verbreitet. Im Gegensatz zum deutschen hat der italienische Gesetzgeber den Amtsmißbrauch in Artikel 323 codice penale unter Strafe gestellt. Das Delikt hat durch die Anklage hochgestellter Politiker in Italien aktuell auch in Deutschland Bekanntheit erlangt. Die Bestimmung weist eine bewegte Geschichte auf und war in Italien Gegenstand heftiger wissenschaftlicher Auseinandersetzungen. Darauf geht die vorliegende Abhandlung anhand der Erläuterung der Tatbestandsmerkmale ein. Darüber hinaus wird untersucht, worin die Gründe für das Fehlen einer entsprechenden Norm im deutschen Recht zu sehen sind und inwiefern eine Inkriminierung der Zweckentfremdung von Amtskompetenzen hierzulande unter den Gesichtspunkten der Strafwürdigkeit und Strafbedürftigkeit in Betracht käme.

Abstract

Die Frage, ob das BGB den Herausforderungen der Digitalisierung noch gerecht werden kann, steht im Mittelpunkt dieser Publikation. Um dem auf den Grund zu gehen, untersucht der Autor den Begriff »digitale Inhalte«, der seit Umsetzung der Verbraucherrechterichtlinie im BGB zu finden ist. Mithilfe einer Kategorisierung der Erscheinungsformen digitaler Inhalte ordnet er diese vertragstypologisch zu. Mit dem so gefundenen Ergebnis macht der Autor legislative Vorschläge für eine alternative rechtliche Handhabbarkeit. Dabei nimmt er auch den von der Europäischen Kommission vorgelegten Vorschlag für eine spezielle Richtlinie für digitale Inhalte in den Blick und verbindet mit ihm die Zuversicht, dass es sich dabei um ein sinnvolles Update für das BGB handeln könnte.

Am 22. Juni 2018 fand in Göttingen das 12. Kriminalwissenschaftliche Kolloquium, am folgenden Tag das Symposium aus Anlass des Abschieds von Jörg-Martin Jehle statt. Im selben Jahr wurde Jörg-Martin Jehle nach 22 Jahren an der Georg-August-Universität Göttingen emeritiert. Dieses Ereignis fiel zusammen mit dem 50. Geburtstag der Göttinger Kriminologie, dem das 12. Kolloquium gewidmet war. Das vorliegende Werk ist aufgrund dieser Veranstaltungen zustande gekommen und enthält einige zusätzliche Beiträge zu Ehren von Jörg-Martin Jehle von engen Weggefährtinnen und Weggefährten, die aus verschiedenen Gründen an den Veranstaltungen nicht mitwirken konnten. Der Band versammelt Aufsätze zur Geschichte kriminologischer Forschung an der Universität Göttingen sowie zu den Themengebieten freiheitsentziehende Sanktionen, Täterforschung, Sanktionswirkungen, Strafrechtsreform sowie historische und internationale Perspektiven. Abstract

"In this book, Jan Deckers addresses the most crucial question that people must deliberate in relation to how we should treat other animals: whether we should eat animal products. Many people object to the consumption of animal products from the conviction that it inflicts pain, suffering, and death upon animals. This book argues that a convincing ethical theory cannot be based on these important concerns: rather, it must focus on our interest in human health. Tending to this interest demands not only that we extend speciesism—the attribution of special significance to members of our own species merely because they belong to the same species as ourself—towards nonhuman animals, but also that we safeguard the integrity of nature. In this light, projects that aim to engineer the genetic material of animals to reduce their capacities to feel pain and to suffer are morally suspect. The same applies to projects that aim to develop in-vitro flesh, even if the production of such flesh should be welcomed on other grounds. The theory proposed in this book is accompanied by a political goal, the ‘vegan project’, which strives for a qualified ban on the consumption of animal products. Deckers also provides empirical evidence that some support for this goal exists already, and his analysis of the views of others—including those of slaughterhouse workers—reveals that the vegan project stands firm in spite of public opposition. Many charges have been pressed against vegan diets, including: that they alienate human beings from nature; that they increase human food security concerns; and that they are unsustainable. Deckers argues that these charges are legitimate in some cases, but that, in many situations, vegan diets are actually superior. For those who remain doubtful, the book also contains an appendix that considers whether vegan diets might actually be nutritionally adequate."

Abstract

In den vergangenen Jahren hat die grenzüberschreitende Nutzung urheberrechtlich geschützter Werke stark zugenommen. Dabei ist neben der Frage der internationalen Zuständigkeit der Gerichte auch das internationalprivatrechtliche Problem des materiell anwendbaren Rechts in den Mittelpunkt der Aufmerksamkeit gerückt. Besonders kontrovers diskutiert wird dieses hinsichtlich der Bestimmung der originären Inhaberschaft am Urheberrecht. Das Werk beschäftigt sich mit der kollisionsrechtlichen Behandlung dieses Aspektes bei Sachverhalten mit grenzüberschreitenden Bezügen. Nach einer wissenschaftlichen Hinterfragung der im internationalen Urheberrecht diskutierten Grundprinzipien der Anknüpfung an die lex loci protectionis einerseits und die lex originis andererseits und einer Darstellung der Rechtslage in Deutschland, Frankreich und den USA wird eine Kollisionsregel entwickelt, welche trotz der unterschiedlichen nationalen Ansätze einen einheitlichen, internationalen Ansatz bilden könnte. Dabei spielen auch die Vorgaben der internationalen Abkommen und des Europäischen Rechts eine Rolle.
