Abstract

Modern medical technologies, especially the pre-implantation and prenatal diagnosis, have given the possibility of preventive dealing with the risks of physical or mental disabilities. On the other side there is the call for support and “inclusion” of people with disabilities. These opposing trends are critically analyzed and discussed in depth from a legally, genetic, as well as from a medical, social and ethical point of view.

Abstract

"Seit vielen Jahren wird eine intensive Debatte über die Auswirkungen exzessiver Mediennutzung geführt. Prominente Themen sind die Auswirkungen gewalthaltiger Medien auf gewalttätiges Verhalten oder die Auswirkungen exzessiver Mediennutzung auf schulische Leistungen. Ferner wird die Frage nach einer „Mediensucht“ diskutiert. Oft verharrt diese Debatte jedoch, selbst in der Wissenschaft, an den beiden Polen „Medien wirken“ und „Medien wirken nicht“, die beide in ihrer Schwarz-Weiß-Malerei das Bild verfehlen. Für die Wirkbereiche Schulleistung, Gewaltverhalten, Fettleibigkeit, Computerspielabhängigkeit sowie für die Prävention einer exzessiven Mediennutzung, wird zunächst ein umfassender Überblick über den internationalen Forschungsstand gegeben. Anschließend werden eigene Ergebnisse der breit angelegten 4jährigen Längsschnittstudie Berliner Längsschnitt Medien präsentiert. Im Ergebnis zeigt sich ein differenzierteres, aber dennoch eindeutiges Bild: Medien sind in allen genannten Bereichen ein wichtiger und bedeutsamer Risikofaktor, aber beileibe nicht der einzige."

Abstract

Die Studie befasst sich mit der rechtlichen Gestaltung einer kindorientierten Familienpolitik in vier europäischen Ländern mit unterschiedlichen sozialstaatlichen Arrangements. Ziel ist es, das Spektrum an Maßnahmen und Interventionen zur Gewährleistung des Rechtes von Kindern auf materielle Ressourcen und kindgerechte Betreuung systematisch zu erfassen und die Komplexität der „Leistungen für Kinder“ im Spannungsfeld öffentlicher und privater Verantwortung aufzuzeigen: Wie wird das Recht des Kindes auf Unterhalt und Betreuung geschützt, wie und weshalb soll der Staat Eltern in ihren Elternfunktionen unterstützen? Wie wirken sich Grundprinzipien wie die Gleichstellung aller Kinder unabhängig von ihrem Geburtsstatus auf sozialrechtliche Leistungen aus? Die vier Länderstudien analysieren Unterschiede und zunehmende Gemeinsamkeiten hinsichtlich der Begründung einer öffentlichen Verantwortung für die junge Generation. Die vergleichende Auswertung stützt sich auch auf gemeinsame europäische und internationale normative Vorgaben.

Abstract

The „as efficient competitor“-standard has gained great practical significance when assessing exclusionary conduct – not least because of the „more economic approach“. The thesis investigates the standard’s historical and economic backgrounds, analyses its history of application and undertakes a critical assessment based on the aforementioned factors. The thesis follows a comparative law approach and is highly interdisciplinary. Thereby it majorly contributes to the controversial topic of how industrial organisation’s findings can be made viable for the application of law in light of versatile shortcomings. It adds to a clarification of the demanding prohibition rules on exclusionary conduct by providing important insights into the application of the „as efficient competitor“ test. By doing so, it aims at attracting the interest of academic scholars as well as professionals.

Abstract

This book documents the inaugural public lecture of Honorary Professor Dr. Murad Erdemir, held on May 28th 2014 in the auditorium of the University of Göttingen. Murad Erdemir is the Vice Director and General Counsel in the Hessian State Authority for Commercial Broadcasting and New Media (LPR Hessen). His inaugural lecture looks at human dignity as a central concept of law and ethics. The lecture covers the media law review and also the supervisory practices of the State Media Authorities and the German Press Council. The full text is reprinted, also including references and further reading.

Abstract

Endanger law ('Gefährdungsrecht') is a criminal law which is seeking security – and thereafter fighting ‘risks’ and ‘dangers’ – as its main objective and which is acting on the basis of risk patterns developed by this law itself. Individuals who fit these characteristics are being fought against as endangerers, that means, as high risky figures – and not as offenders. In this work it is presented this figure which has been constructed by the criminal policies and system in Germany during recent years, and has been co-constructed by the Constitutional Court in at least two cases: in the case of the acoustic home surveillance and in the case of the subsequent incapacitation order. Here is (critically) explained the internal logic and rationality which is leading this endanger law.

Le thème de la (dis)continuité en Droit ne peut laisser indifférent nul juriste, nul historien ou théoricien du Droit. Les communications rassemblées dans cet ouvrage en témoignent par leur diversité disciplinaire. Pour aborder un tel objet d'étude d'une redoutable ampleur, l'axe temporel et l'axe spatial ont été retenus. Sur l'axe du temps, la continuité se donne comme l'expression de la permanence des principes et des institutions résistant aux ruptures ; elle évoque une intangibilité rêvée. Face aux évolutions exigeant des abandons et des réformes, elle devient la résistance de l'existant, cédant difficilement par des réformes apparentes. Et quand l'abandon de l'ancien ne peut être évité, elle se transforme en transition qui ménage un pont au-dessus du fossé qui sépare (ou veut séparer) désormais le passé et le présent. Sur l'axe de l'espace, la continuité se manifeste dans les liaisons entre éléments d'un même ensemble processuel, normatif ou institutionnel. Elle préside encore à l'établissement de liens entre sphères d'activités ou d'intérêts connexes et entre territoires contigus. Ainsi, la continuité est au cœur des impératifs de sécurité et de cohérence juridiques, de pacification et de cohésion sociales.

Abstract

The evolution of activism against the expansion of copyright in the digital domain, with case studies of resistance including eBook and iTunes hacks.The movement against restrictive digital copyright protection arose largely in response to the excesses of the Digital Millennium Copyright Act (DMCA) of 1998. In The Digital Rights Movement, Hector Postigo shows that what began as an assertion of consumer rights to digital content has become something broader: a movement concerned not just with consumers and gadgets but with cultural ownership. Increasingly stringent laws and technological measures are more than incoveniences; they lock up access to our “cultural commons.”Postigo describes the legislative history of the DMCA and how policy “blind spots” produced a law at odds with existing and emerging consumer practices. Yet the DMCA established a political and legal rationale brought to bear on digital media, the Internet, and other new technologies. Drawing on social movement theory and science and technology studies, Postigo presents case studies of resistance to increased control over digital media, describing a host of tactics that range from hacking to lobbying.Postigo discusses the movement's new, user-centered conception of “fair use” that seeks to legitimize noncommercial personal and creative uses such as copying legitimately purchased content and remixing music and video tracks. He introduces the concept of technological resistance—when hackers and users design and deploy technologies that allows access to digital content despite technological protection mechanisms—as the flip side to the technological enforcement represented by digital copy protection and a crucial tactic for the movement.

Abstract

This chapter highlights the relevance of text categorisation for research in legal translation by focusing on institutional translation settings, namely: the European Union (EU), the United Nations (UN) and the World Trade Organization (WTO), and their corresponding adjudicative bodies.1 After briefly reviewing recurrent issues and models of legal text classification (section 2), a multidimensional approach is applied to the multilingual text production of the three representative institutional translation settings during three years over the span of a decade (2005, 2010 and 2015), as part of the project “Legal Translation in International Institutional Settings: Scope, Strategies and Quality Markers” (LETRINT) (section 3). The resulting subdivisions are integrated into a categorisation matrix and discussed as a way of illustrating the relative nature and implications of text classifications. The fine-grained description of corpus design and representativeness, technical aspects of corpus compilation and full taxonomies of genres are not addressed in this chapter.

Abstract

This chapter reflects on what materiality-inflected methodologies1 can bring to an anthropology of law, and to legal studies more generally. Its starting point is an increasing attention across the social sciences and humanities for objects, and thinking beyond the human. These have often, but not only, emerged from science and technology studies (STS), to which we pay particular attention. However, approaches to materiality have themselves become diversified, and their implications for law can similarly be read in multiple ways. At the same time, legal anthropology has helped to re-characterise the complexity of law as a field of social activity by paying attention to its meanings, for actors within as well as outside its own institutions; to its modes of action in practice, again within its explicitly designated spaces as well as its everyday; to its unexpected forms, patterns and directions; to its multiplicity and uncertainty. Approaches within a broadly defined ‘legal anthropology’ agenda have provided tools to move away from grand and removed theorisation of the law, or an exclusive attention to its own claims, and towards a subtler understanding of law as a relatively fluid, changing and uncertain set of practices. While doing so, legal anthropology has also reminded us of the significance of empirical research to identify and theorise the complex existences of law, a contribution which echoes some of the implications of materiality-oriented theories.
