Abstract

This study examines the emergence of new forms of Islamic spirituality in Indonesia identified as Majlis Dhikr. These Majlis Dhikr groups have proliferated on Java in the last two decades, both in urban and rural areas, and have attracted followers from a wide social background. The diverse aspects of these Majlis Dhikr groups – their rituals, teachings and strategies of dissemination as well as the popular understanding of these rituals and their contestation by critics and opponents – are examined in detail and illustrated by reference to three particular groups – Salawat Wahidiyat, Istighathat Ihsaniyyat and Dhikr al-Ghafilin each of which has its own distinctive features and notable religious leadership. These Majlis Dhikr groups regard their activities as legitimate ritual practices that are in accordance with the legacy of Islamic Sufism based on the interpretation of the Qur’anic and Prophetic tradition.

Abstract

The German reunification in 1989/90 is paradigmatic for fundamental geopolitical changes, in the context of a change of the entire legal system. Further well-known examples of the State’s national desire for reformations with respect to legal principles are the great reform of the penal system in 1975, the reform of the law of obligations in 2002 and the fundamental reorganization of the law with respect to illiquid debtors. The Koreans are not only interested in the Germans’ experience of the last quarter of a century because of legal-historical reasons, but also in particular because of the possible case of a Korean reunification. The present volume contains the contributions to the 4th symposium of the Faculty of Law of the Georg-August-Universität Göttingen and the Yonsei Law School (Seoul), which was held in Göttingen in February 2015.

Abstract

"Military leaders are faced with high expectations when it comes to handling unforeseen situations in joint military operations. This chapter aims to present a nuanced professional and pedagogical discussion of how an increased awareness of the concept of samhandling in the use of military doctrines may contribute to the professionalization of military higher education. Different doctrines reflect different theoretical decisions. They are given relevance in education as a way to illustrate formal examples of what is preferred and what is rejected. As doctrines are built on experiences from real-life scenarios, as well as on predictions and strategies for possible change, they may serve as a way of balancing the branch-specific “hidden curriculum”, i.e. an established culture with a set of current values, behavior and thinking that have been developed over time in the organization. The findings in the current case study indicate that military doctrines are regarded as important in leadership training at the Norwegian Military Academy, especially when it comes to understanding and guiding samhandling in unforeseen and risk-oriented situations. However, at the same time, the terms used to describe samhandling in military doctrines found relevant in education at the Norwegian Military Academy are numerous, vague and somewhat overlapping. It seems crucial to raise awareness of the underlying processes and the relational ambition level that forms the basis of the chosen term. It is advantageous to reach a collective understanding of the kind of skills that need to be developed and trained. Another benefit of such analysis is to provide a basis for clarified learning goals and practical scenario development through exercises and other teaching plans in leadership education, as well as the evaluation of this, both in terms of learning outcomes and education as a whole."

Abstract

Abstract

Whether it is a question of the age below which a child cannot be held liable for their actions, or the attribution of responsibility to defendants with mental illnesses, mental incapacity is a central concern for legal actors, policy makers, and legislators when it comes to crime and justice. Understanding the terrain of mental incapacity in criminal law is notoriously difficult; it involves tracing overlapping and interlocking legal doctrines, current and past practices including those of evidence and proof, and also medical and social understanding of mental order and incapacity. Bringing together previously disparate discussions on criminal responsibility from law, psychology, and philosophy, this book provides a close study of mental incapacity defences, analysing their development through historical cases to the modern era. It maps the shifting boundaries between normality and abnormality as constructed in law, arguing that ‘manifest madness’ — the distinct character of mental incapacity revealed by this interdisciplinary approach — has a broad significance for understanding the criminal law as a whole.
