Abstract

The commercialisation of sport in Europe raises important questions concerning the most appropriate method of regulating sporting activity. The development of the European Union and the internationalisation of sporting competition has added an international dimension to this debate. Yet sport is not simply a business to be regulated in the same way as any other industry. It is also a social and cultural activity. Can regulation at EU level reconcile this tension? Adopting a distinctive legal and political analysis, this book argues that the EU is receptive to the sports sectors claims for special treatment before the law. The book investigates the birth of EU sports law and policy by examining: the Bosman ruling and other significant European Court of Justice decisions; the relationship between sport and EU competition law; the possibility of sport being exempt from EU law; the relationship between sport and the EU Treaty; the development of a EU sports policy. Abstract

Développer l’utilisation durable des substances naturelles, faire de la protection de la biodiversité une activité rentable pour mieux la promouvoir tout en favorisant le développement des territoires concernés : il y a là, dans le contexte actuel, des enjeux importants pour la Polynésie française. En effet, la Polynésie française bénéficie d’un potentiel intéressant par sa diversité (marine et terrestre) et ses spécificités, liées notamment à l’insularité. C’est ce qu’atteste le succès de quelques-uns de ses produits mondialement connus : perles, monoï, jus de nono, vanille. Mais la mise en valeur de ce potentiel demeure encore limitée ; son inventaire lui-même reste très partiel. Pour en préciser les dimensions réelles, cette expertise collégiale s’est attachée à évaluer scientifiquement la ressource, tout en mettant en évidence les substances d’intérêt et les orientations de recherche prioritaires. Les conditions socio-économiques, juridiques et techniques de la mise en valeur de cette ressource sont analysées ici aux fins de fournir des éléments de connaissance et des recommandations utiles à la définition par la Polynésie d’une politique originale de valorisation de ses substances naturelles.

Abstract

The autonomy of sport which is constitutionally recognised is not consistently respected by EU law. There are complaints that the necessary cooperation of the federations in sport is not sufficiently taken into account. This is where the speakers of the 9th International Hamburg Symposium "Sport and Economics" come in when they address legal and economic questions about major sporting events and discuss proposals on the status of sport in the European context. It shows that sport is economically shaped, which has not yet found an adequate equivalent at European level. This is evident, for example, in sports betting and the gambling monopoly.The volume will further stimulate the debate created by the EU White Paper on Sport and the Bundestag resolution on sport in Europe.
