Abstract

Der vorliegende Band vereinigt die Referate des am 25. November 2011 veranstalteten 10. Göttinger Workshops zum Familienrecht, der die anstehende Reform des nichtehelichen Eltern-Kind-Verhältnisses zum Gegenstand hatte. Die Beiträge beschäftigen sich mit den derzeit diskutierten Lösungsmodellen zur Ausgestaltung der elterlichen Sorge nicht miteinander verheirateter Eltern und beleuchten das nichteheliche Eltern-Kind-Verhältnis auch aus rechtsvergleichender und interdisziplinärer Perspektive. Darüber hinaus werden mögliche Auswirkungen einer Reform des Sorgerechts auf das Adoptionsrecht sowie der durch die Rechtsprechung veranlasste Reformbedarf im Abstammungsrecht diskutiert. Im Hinblick auf den inzwischen vorliegenden Regierungsentwurf eines Gesetzes zur Reform der elterlichen Sorge nicht miteinander verheirateter Eltern haben die in diesem Band enthaltenen rechtspolitischen Forderungen zusätzlich an Aktualität gewonnen. Band 13 der Reihe „Göttinger Juristische Schriften“ Die Reihe wird von der Juristischen Fakultät der Georg-August-Universität herausgegeben und macht Veranstaltungen an der Fakultät einer interessierten Öffentlichkeit zugänglich.

Abstract

Attachment theory, assessment and research offers a broad, far-reaching view of human functioning, and it can enrich a psychologist's understanding of subjects and their relational adjustment, both in clinical and non-clinical settings. Ongoing research in attachment has led to a number of individual treatments and prevention and intervention programs. The assessment of an individual's attachment organization, can play a crucial role in explaining and previewing the unfolding treatment, the relational adjustments or concerns, and the psychological well-being. We hope to receive empirical papers that give evidence for the usefulness of attachment assessment in both clinical (e.g., patients with Eating Disorder; or Axis-II; psychotherapy patients…) or not clinical population (e.g. Adoptive and/or foster families or couples, Mother-infant assessment in prevention field…). These papers should include methodological issues and information about the participants, the methods used to assess attachment, the process of scorer training and the availability of the manual used to obtain inter-scorer reliability. Case studies may be of interest to the extent that they demonstrate the value of a systematic approach to attachment material. A range of theoretical perspectives is welcome as well presentation of new emergent tools on attachment. Because Frontiers in Psychology is an international journal, each empirical paper should comment on the international implications of the findings and discuss its cross-cultural use. Such comments may include, for example, its linguistic specificity, its robustness in translation, and the cross-cultural generalizability of the constructs and behaviors of the measure and its usual correlates. Cross-cultural generalizability is not, however, a requirement.

Abstract

This paper presents the results of a pilot study about students’ adoption and learning outcomes of 4 MOOCs proposed as a complementary resource for traditional remedial courses on calculus. While the MOOCs were not mandatory, traditional remedial courses were required for those freshmen failing a diagnostic exam. The effects on 589 freshmen students were investigated. The data analysis shows that up to 16 % of the students were active in the MOOCs under study, mostly during the days before taking the diagnostic exam that preceded the traditional face-to-face remedial courses. Trace data about learner actions within the platform were collected as well as the students’ scores. According to a statistical comparison of the students’ exam scores and their interaction behavior with the MOOCs, we observe that active students had more chances of passing the diagnostic exam and skipping the required remedial courses. However, we found no significant differences on the remedial course exam scores between the students that were active in the MOOCs and those that were not. These findings suggest that MOOCs are a good solution to strengthening skills and reviewing concepts, but that more guidance is needed when used as a complement to traditional f2f courses.

Abstract

Si l'on choisit ses amis, on ne peut pas choisir sa famille, déplore l'adage. Ce livre collectif démontre que, bien au contraire, la volonté tient de plus en plus de place dans la création de la filiation. C'est le cas notamment entre parents et enfants adoptés, qu'il s'agisse d'adoptions légales ou de celles, par leurs pères, d'enfants nés d'insémination avec donneurs, ou encore d'« adoptions » informelles au sein des familles recomposées. Nous cherchons aussi à forger, parmi les parents de sang et leurs alliés, des réseaux relationnels privilégiés. Chacun opère des choix, « adopte » ou rejette des ancêtres, des beaux-parents, des frères et sœurs, des parents, voire des enfants. Quelles sont, dans les sociétés occidentales, les formes, les effets et la signification de ces « affinités électives » dans la construction de la parenté ? Et dans la définition de la filiation ? Pour répondre à ces questions, le détour par d'autres sociétés et d'autres temps s'imposait. Qu'est-ce qu'être parent, enfant, frère et sœur, chez les Sulka d'Océanie ou les Inuit de l'Arctique ? Dans la Grèce classique ou dans la Grèce contemporaine ? Dans la France des années cinquante comme dans celle des années quatre vingt- dix ? Ces dix contributions, qu'elles soient centrées sur l'adoption proprement dite ou sur des affiliations informelles, sur des sociétés privilégiant les liens du sang ou l'échange affectif, permettent de mieux comprendre notre propre système de filiation et ses récents bouleversements.

Abstract

Les structures de parenté sont dans l’histoire et, comme telles, elles ne cessent de se transformer, mais elles le font à un rythme et selon des modalités qui diffèrent de ce que l’on observe pour la vie politique, économique ou religieuse. Avec une histoire que, depuis Homère, on peut suivre sur près de trois millénaires, la Grèce offre à cet égard un champ d’observation d’une profondeur exceptionnelle. Le but de cette recherche est de cerner à la fois la continuité et les modifications d’un système de parenté. Cette « étude de terrain » est aussi l’occasion d’approfondir la réflexion sur la notion de parenté. Anthropologues et historiens des diverses périodes de l’histoire de la Grèce, depuis l’archaïsme jusqu’à l’époque contemporaine, se sont retrouvés autour de ce thème lors d’un colloque réuni à Volos du 18 au 21 Juin 2003. Ce volume en constitue les actes.

Abstract

Rules of the House examines the transformation of the Korean family during and after Japanese colonial rule. Through in-depth reading of civil litigation records, the book shows how the Japanese colonial legal system transformed Korean families from the traditional patrilineal family system into small, patriarchal households. The new domestic pattern proved remarkably durable, forming the basis of postcolonial family life. Women feature prominently in the book. Increasingly marginalized by patriarchy, women embodied the fault line between one family system as it receded and the other as it expanded under the auspices of Japanese colonial law. As a consequence, women’s rights to family property, inheritance, divorce, and adoption of heirs were frequently challenged by family members. Far from being quiet victims, these women brought their cases to the colonial courts and won a surprising number of cases. The book highlights how legal discourse about women’s rights in colonial civil courts articulated the transformation of the family.&#xD;

Abstract

This book is based on a Special Issue of the journal LAND that draws together a collection of 11 diverse articles at the nexus of climate change, landscapes, and livelihoods in rural Africa; all explore the links between livelihood and landscape change, including shifts in farming practices and natural resource use and management. The articles, which are all place-based case studies across nine African countries, cover three not necessarily mutually exclusive thematic areas, namely: smallholder farming livelihoods under new climate risk (five articles); long-term dynamics of livelihoods and landscape change and future trajectories (two articles); and natural resource management and governance under a changing climate, spanning forests, woodlands, and rangelands (four articles). The commonalities, key messages, and research gaps across the 11 articles are presented in a synthesis article. All the case studies pointed to the need for an integrated and in-depth understanding of the multiple drivers of landscape and livelihood change and how these interact with local histories, knowledge systems, cultures, complexities, and lived realities. Moreover, where there are interventions (such as new governance systems, REDD+ or climate smart agriculture), it is critical to interrogate what is required to ensure a fair and equitable distribution of emerging benefits.
