Abstract

"Die moderne Lehre von der Gesetzesauslegung beruht im Wesentlichen auf der Interpretationstheorie des frühen 20. Jahrhunderts. Der Vortrag stellt diese Theorie in den historischen Zusammenhang. Ihre Grundlage ist ein neuer, positivistisch-voluntaristischer Rechtsbegriff. Aus ihm erklärt sich die um 1900 aufkommende Vorstellung, es gebe Lücken im Recht, die nur durch richterliche Rechtsschöpfung gefüllt werden können. Mit ihm hängt auch die Uneinigkeit darüber zusammen, ob das Ziel der Auslegung darin besteht, den gegenwärtig vernünftigen Gesetzessinn (objektive Theorie) oder den Willen des Gesetzgebers (subjektive Theorie) zu ermitteln, oder ob die Auslegung im Rahmen der gegebenen Möglichkeiten dem Ermessen des Interpreten zu überlassen ist (Reine Rechtslehre).Der Autor war bis zu seiner Pensionierung (2009) Ordinarius für Deutsche Rechtsgeschichte und Bürgerliches Recht an der Universität Tübingen; er gilt als einer der besten Kenner der Geschichte der juristischen Methodenlehre."

Abstract

Heinrich Zoepfl (1807-1877), Heidelberg Professor of Legal History and Constitutional Law, was active in the turbulent times of the "Vormärz", the "German Revolution" of 1848/49 and the foundation of the German Reich in 1870/71. He took an active part in all events, both in the lecture hall and through his writings, in the First Baden Chamber and in the Erfurt Union Parliament, as well as through widespread activity as an expert. As such, he advised the government in Karlsruhe, those affected by political repression, cities, parliaments and individuals, but especially numerous "mediatized" aristocratic houses, which not only had to cope with their loss of political power, but also had to solve many internal legal issues. Zoepfl was always involved as an expert on aristocratic professional law. For the first time, this volume presents a list of Zoepfls' unprinted and printed expert reports, commission reports, and works that can be found in Heidelberg University Library. Biographical details and an appreciation of his textbooks are followed by critiques of selected expert opinions, and historical outlines of the political situation in Zoepfl's lifetime.

Abstract

The volume is containing the critical edition of 207 letters of pope Innocent III’ addressed to recipients all over Europe and in the Middle East which were entered into the chancery registers of the 13th year of pontificate (1210/1211). It is the first of four volumes transmitted not as original but as a copy written at the Curia in mid-14th century and as print published in the 17th century.

Abstract

The fourteenth volume of the critical edition of pope Innocent III’s chancery-registers is containing 161 letters addressed to recipients all over Europe and in the Middle East. In this year of the pontificate, no geographical focus is discernible. However, christianitas as threatened at three frontiers (in Spain and the East by Muslims, in Southern France by heretics) is a topic constantly recurring in the Pope’s letters. The register of Innocent’s fourteenth year of pontificate is one of the four volumes transmitted not as original but as a copy written at the Curia in mid-14th century and as print published in the 17th century.

Abstract

Justice Robert H. Jackson, plenipotentiary for planning the Allies trial at the International Military Tribunal, called the trial “one of the most significant tributes ever paid by power to reason.” In Justice Jackson’s opening statement he made it clear that the trial at Nuremberg was to mark a new beginning in human history; that Nuremberg would serve to establish principles that could serve as benchmarks for all human behavior. This revised and extended Edition seeks to address both the short-term effects of the International Military Tribunal and the current impact that the trials have had on international law.The first section of the book contains essays which are written by leading scholars such as Christoph J.M. Safferling, looking at German participation in the Nuremberg Trials, to Winifried R. Garscha’s examination of Austrian War Crimes Trials and the concept of “Violation of Human Dignity.” This section will also include an examination of the influence of Nuremberg on the Tokyo War Crimes Trial.The second section of the book addresses the present-day impact of Nuremberg on international law. This section contains essays on selective justice, human rights litigation, the creation of hybrid tribunals, with new essays addressing sexual and gender-based violence in conflict zones, as well as new work on the Nuremberg Project, located at Harvard University.The hope for this volume is that the spirit of Nuremberg will be revived.
