Abstract

Risk in banking business can not be avoided because the latter is strongly embedded in the very nature of it and banks should therefore be aware of the importance of effective risk management, encompassing the identification, measurement and assessment of each type of risk. Risk management can be important source of gaining competitive advantage and a way to survive in the world of banking. One of the most important risk in bank is the credit risk. Credit risk can be defined as the potential that a bank borrower or counterparty will fail to meet its obligations. The goal of credit risk management is to maximise bank´s risk-adjusted rate of return by maintaining credit risk exposure within acceptable parameters. Banks need to manage the credit risk inherent in the entire portfolio as well as the risk in invidual credits of transaction. Banks should also consider the relationships between credit risk and other risks. The effective management of credit risk is a comprehensive component of a comprehensive approach to risk management and essential to the long-term success of bank. Risk management is usualy regulated by bank directives, prescriptions, where the most important in Slovenia is the Law about banking with under law acts.

Abstract

There is a growing appreciation that many psychiatric (and neurological) conditions can be understood as functional disconnection syndromes – as reflected in aberrant functional integration and synaptic connectivity. This Research Topic considers recent advances in understanding psychopathology in terms of aberrant effective connectivity – as measured noninvasively using functional magnetic resonance imaging (fMRI).Recently, there has been increasing interest in inferring directed connectivity (effective connectivity) from fMRI data. Effective connectivity refers to the influence that one neural system exerts over another and quantifies the directed coupling among brain regions – and how they change with pathophysiology. Compared to functional connectivity, effective connectivity allows one to understand how brain regions interact with each other in terms of context sensitive changes and directed coupling – and therefore may provide mechanistic insights into the neural basis of psychopathology.Established models of effective connectivity include psychophysiological interaction (PPI), structural equation modeling (SEM) and dynamic causal modelling (DCM). DCM is unique because it explicitly models the interaction among brain regions in terms of latent neuronal activity. Moreover, recent advances in DCM such as stochastic and spectral DCM, make it possible to characterize the interaction between different brain regions both at rest and during a cognitive task.

Abstract

After roughly 15 years of merger control application in the Federal Republic of Germany a reassessment of the significance of this instrument of antitrust policy seems necessary. This is particularly so in view of the reorientation of merger control policy in the United States which has been - in its original version - the model for the German merger control system.
Concerning merger control, the reorientation is characterized by the notion that the structure-conduct-performance paradigm which has dominated U.S. antitrust for a quarter of a century is imprecise or even incorrect and «that bigness in business does not necessarily mean badness.»
This makes the fundamental question arise of whether the German merger control system is still up to date in terms of the underlying market theory and of whether the German Act Against Restraints of Competition needs a reorientation towards aspects of market conduct and performance instead of market structure by means of a Fifth Amendment.

Abstract

Youth violence: sources and solutions in South Africa thoroughly and carefully reviews the evidence for risk and protective factors that influence the likelihood of young people acting aggressively. Layers of understanding are built by viewing the problem from a multitude of perspectives, including the current situation in which South African youth are growing up, perspectives from developmental psychology, the influences of race, class and gender, and of the media. The book examines the evidence for effective interventions in the contexts of young people’s lives – their homes, their schools, their leisure activities, with gangs, in the criminal justice system, in cities and neighbourhoods, and with sexual offenders. In doing so, thoughtful suggestions are made for keeping an evidence-based perspective while (necessarily) adapting interventions for developing world contexts, such as South Africa.

Abstract

The starting point for my thesis, or rather the revised version of my thesis, was the fact that parties in a civil, criminal or administrative case have no legal entitlement either to the launch of judicial review proceedings (Normprüfungsverfahren) by the Austrian constitutional court (VfGH) or to the submission of questions of interpretation to the ECJ. The absence of any such legal entitlement raises the question of whether a party could not obtain a remedy by taking the direct route using an Individualantrag or individual application to the constitutional court in accordance with Art 139 or Art 140 B-VG (Austrian Federal Constitutional Act). In practice, however, this route is frequently blocked by the strict prerequisites for admissibility and formal requirements governing an individual application. This paper analyses whether the rigid admission procedure truly reflects the aim of the constitution/legislator. The focus of this paper is thus a detailed analysis of the Individualantrag. &#xD;In the event of failure to obtain a mandatory preliminary ruling from the ECJ, VfGH practice recognises that this constitutes violation of the Austrian right to a hearing before an impartial and competent judge (Recht auf den gesetzlichen Richter). The thesis/the revised version of this thesis highlights a further interpretation of the above right to a hearing, an interpretation under which unlawful failure to launch a judicial review also constitutes breach of this right. Furthermore, the paper examines whether Art 13 ECHR (Right to an effective remedy) and Art 6 ECHR (Right to a fair trial) are also violated in the two aforementioned cases. Established case law states that claims for state liability on the grounds of state contravention of Community law are to be brought under the constitutional court's Kausalgerichtsbarkeit or jurisdiction for monetary claims against public bodies for which there is no other remedy, in accordance with Art 137 B-VG. In the light of this, this paper looks in detail at why unlawful failure to launch judicial review proceedings can also result in claims for state liability.&#xD;It also uncovers shortcomings in legal remedy in the implementation of EU law. In the context of the above topics, which form the core of my thesis/the revised version of my thesis, the paper will introduce the system of legal remedy under the Austrian federal constitution including the key ordinary and extraordinary remedies under sovereign, public administration (Hoheitsverwaltung), briefly address legal remedy under private law administration (Privatwirtschaftsverwaltung), and finally outline other institutions with responsibility for legal relief such as the Volksanwaltschaft (Austrian Ombudsman Board) and the Rechnungshof (Austrian Court of Auditors).&#xD;&#xD;

Abstract

Eine der wichtigsten Innovationen der Wirtschaftsgemeinschaft Westafrikanischer Staaten (ECOWAS) ist die eindeutige Gewährung einer supranationalen Rolle an den Gerichtshof der Organisation. Sein Menschenrechtsmandat hat jedoch zu realen und potenziellen Spannungen innerhalb der ECOWAS-Rechtsordnung geführt.Die Spannungen ergeben sich aus der Rechtskraft von Urteilen von Verfassungsgerichten der Mitgliedstaaten und der Zulässigkeit von Individualbeschwerden vor dem Gerichtshof. Diese Arbeit zeigt einige Mängel in der derzeitigen Regelung des Menschenrechtsmandats des Gerichtshofs auf. Lücken bestehen sowohl auf der Ebene der verfassungsmäßigen Ordnung der Mitgliedstaaten als auch auf der Ebene der Gemeinschaft. Die supranationale Menschenrechtsgerichtsbarkeit muss durch die Möglichkeit umgesetzt werden, konkrete Abhilfemaßnahmen zur Behebung von Menschenrechtsverletzungen an die betroffenen Mitgliedsstaaten anzuordnen. In dieser Arbeit werden innovative Lösungen vorgeschlagen, um prozessuale und substantielle Lücken im etablierten Menschenrechtsschutzsystem in Westafrika zu schließen.

Abstract

The representation of the Earth's surface in global monitoring and forecasting applications is moving towards capturing more of the relevant processes, while maintaining elevated computational efficiency and therefore a moderate complexity. These schemes are developed and continuously improved thanks to well instrumented field-sites that can observe coupled processes occurring at the surface–atmosphere interface (e.g., forest, grassland, cropland areas and diverse climate zones). Approaching global kilometer-scale resolutions, in situ observations alone cannot fulfil the modelling needs, and the use of satellite observation becomes essential to guide modelling innovation and to calibrate and validate new parameterization schemes that can support data assimilation applications. In this book, we review some of the recent contributions, highlighting how satellite data are used to inform Earth surface model development (vegetation state and seasonality, soil moisture conditions, surface temperature and turbulent fluxes, land-use change detection, agricultural indicators and irrigation) when moving towards global km-scale resolutions.

Abstract

Kinetics and reactor modeling for heterogeneous catalytic reactions are prominent tools for investigating and understanding catalyst functionalities at nanoscale and the related rates of complex reaction networks. This book illustrates some examples related to the transformation of simple to more complex feedstocks, including different types of reactor designs, i.e., steady-state, transient plug flow reactors, and TAP reactors for which there is sometimes a strong gap in the operating conditions from ultra-high-vacuum to high-pressure conditions. In conjunction, new methodologies have emerged, giving rise to more robust microkinetics models. As exemplified, they include the kinetics and the dynamics of the reactors and span a large range of length and time scales. The objective of this Special Issue is to provide contributions that can illustrate recent advances and novel methodologies for elucidating the kinetics of heterogeneous reactions and the necessary multiscale approach for optimizing the reactor design. This book is dedicated to postgraduate and scientific researchers, and experts in heterogeneous catalysis. It may also serve as a source of original information for the elaboration of lessons on catalysis for Master students.

Abstract

Water Footprint Assessment is a young research field that considers how freshwater use, scarcity, and pollution relate to consumption, production, and trade patterns. This book presents a wide range of studies within this new field. It is argued that collective and coordinated action - at different scale levels and along all stages of commodity supply chains - is necessary to bring about more sustainable, efficient, and equitable water use. The presented studies range from farm to catchment and country level, and show how different actors along the supply chain of final commodities can contribute to more sustainable water use in the chain.
