Abstract

This edited volume of chapters resulted from an international conference held at the University of Adelaide in July 2016 under the same title to explore the multifaceted concept of ʿilm in Islam — its agency and manifestations in the connected realms of science, religion, and the arts. The aim is to explore the Islamic civilisational responses to major shifts in the concept of ‘knowledge’ that took place in the post-mediaeval period, and especially within the context of the ‘early modern’. It asserts that the true value of knowledge lies in its cross-civilisational reach, as when the development of knowledge in pre-modern Islam exerted profound changes onto the Europeans, whose resurgence in the early modern period has in turn forced massive changes onto the Islamic worldview and its systems of knowledge. Now the landscape of knowledge has significantly changed, the Muslim mind, which has been historically calibrated to be particularly sensitive towards knowledge, can and should open to new horizons of knowing where science, religion, and art can meet again on freshly cultivated and intellectually fertile grounds.

Abstract

This book contains the Treatise of contracts of the Provençal Franciscan Pierre de Jean Olivi (1248-1298), in an annotated translation into Spanish by Pedro Ramis-Serra and Rafael Ramis-Barceló, author of a comprehensive preliminary study that revises the historical, legal and institutional background of Olivi, as well as an analysis of the reception of the profile and works by Olivi during the Modern Era. The Treatise of Contracts was the first great Theological-Legal-Economical Treatise on the matter, and it opened a path which, eventually and in the Modern era, was especially fruitful for theologians, jurists and canonists.-----Este libro contiene el Tratado de los contratos del franciscano provenzal Pierre de Jean Olivi (1248-1298), en traducción anotada al español de Pedro Ramis Serra y Rafael Ramis Barceló, autor éste de un amplio estudio preliminar que explica el marco histórico, jurídico e institucional de Olivi, así como un análisis de la recepción de la figura y obra de Olivi en la Modernidad. El Tratado de los contratos fue primer gran tratado teológico-jurídico-económico sobre la materia, y abrió un camino que, a la postre y en la época moderna, fue especialmente fecundo tanto para teólogos, como para legistas y canonistas.

Abstract

The book shows that apprenticeship company networks in Switzerland have an increased integration potential for foreign students and weaker learners at school because they improve their chances of finding job training and prevent apprenticeship contract cancellations. The reasons for this lie in the different way in which selection and training are organised compared with individual in-company training: features specific to the network, such as rotation and shared supervision, increase learners' capabilities and act as institutional conversion factors.

La fiesta de toros en su moderna forma plebeya (la tauromaquia a pie) cuajó en la ciudad de Sevilla, vinculada al matadero municipal, en el siglo XVIII; desde entonces se convierte en un espectáculo que atrae las masas. Este trabajo analiza los tratos jurídicos que vincularon a los diversos interesados en ese espectáculo: los toreros (matadores, picadores, banderilleros), los ganaderos, los maestrantes sevillanos (propietarios de la plaza de toros), los empresarios que organizaron festejos y un amplio catálogo de artesanos que prestan su pericia con ese fin. Se estudia, en particular, la naturaleza de la prestación de servicios entre toreros y empresarios, en sus diversas modalidades (actuaciones singulares o por temporada, contrato de un lidiador o de toda una cuadrilla...), así como la atribución de las consecuencias dañosas de los percances acontecidos durante la lidia. Un apéndice documental recoge las referencias de las escrituras notariales localizadas, con transcripción completa de varias, particularmente significativas.

Abstract

Designing a contract is often more of an economic than a legal problem. A good contract protects parties against opportunistic behavior while providing motivation to cooperate. This is where economics and, especially contract theory, may prove helpful by enhancing our understanding of incentive issues. The purpose of this book is to provide specific tools which will help to write better contracts in real world environments. Concentrating on moral hazard literature, this book derives a tentative checklist for drafting contracts. As an economic contribution to a field traditionally considered an art rather than a science, this treatment also gives much attention to methodological issues.
