Abstract

The Mishna Berura is, without a doubt, Rabbi Israel Meir Kagan's greatest and most complex contribution to the canon of Orthodox Jewish Law; it is a singular work that synthesizes Jewish traditions, laws, and mores into a practical halakhic guide to daily religious life. For all of his traditionalism, Rabbi Kagan was an iconoclast, and the Mishna Berura broke from many of the traditional approaches of deciding halakhic directives. Instead, he favored studying, engaging, and asserting decisions in a nuanced, almost natural approach to how ethical people should live their daily lives consistent with Jewish law. Today, the Mishna Berura has gained widespread recognition and is considered authoritative by essentially all of contemporary Orthodox Jewry, a measure of greatness that few works of Halakha have attained. Michael J. Broyde and Ira Bedzow here investigate this seminal text and explore its background and decision-making process.

Abstract

La notion de simplification est ancienne même si le terme est très récent. S'il est indéniable que la « simplification » des techniques juridiques est un thème récurrent dans les discours sur le droit, dans les cadres nationaux aussi bien que dans le cadre européen, la réalité de cette simplification soulève davantage de débats. De plus, si quelques travaux se sont déjà intéressés à des aspects limités de ce phénomène, c'est en l'étudiant dans le cadre national français, et dans une perspective le plus souvent strictement disciplinaire. Or l'idée de simplification, d'abord confinée aux formalités administratives, a envahi la totalité des branches juridiques et toute l'activité normative française, internationale, communautaire, ce qui n'a pas contribué à la purger de son « ambiguïté profonde, génératrice de nombreuses méprises » Dans le cadre de ce colloque, on s'est efforcé d'aller au-delà de ces approches partielles, afin d'examiner ce phénomène dans une perspective interdisciplinaire. Le point de départ de cette réflexion a été un constat : les différentes disciplines juridiques ont connu des tentatives de simplification, mais qui ont été inégalement heureuses et abouties. On s'est donc proposé de mieux cerner l'idée de simplification et ses manifestations par le croisement de ces expériences, ainsi que le recours à des regards non-juridiques, afin de voir s'il ne serait pas dès lors possible de mieux « conceptualiser » la simplification du droit.

Abstract

"... habent sua fata libelli": Nowadays this saying is usually used to state, that a text is only able to impart as much message, as the reader is willing to understand. However, we can make use of this saying in another sense too - for instance just as James Joyce used to say: to give a "book in print a life of its own"; meaning that the fate of a book is above all built on the fact, that it was put into the world. Of course there are papers, which never caught sight of the world, or which later got lost - for example due to a fire-disaster. On the 15th of July 1927, the most important files about the history of the making of Austria's General Civil Code sustained such a fate, due to the fire-disaster in the Viennese Palace of Justice, where these documents have been treasured at the Archive of the Ministry of Justice.
This destruction, however, did not lead to the total loss of legal sources relevant to the legal history of Austria's General Civil Code. The most important documents regarding the beginning of the composition of the Austrian General Civil Code have been preserved by Harrasowksy in his edition of the Codex Theresianus in 1883/86. Nevertheless some of the eldest materials, that have been marking the very beginning of the composition of the Codex Theresianus in 1753, composed by the first law-making commission, the so called Compilating-Commission, remained disregarded and untouched in the archives: to begin with, this is a "plan", drawn up by Josef Azzoni in May 1753, containing not only a disposition of the content of the Codex Theresianus, but also a first description of it. Therefore this "plan" can be seen just as a preliminary draft of the project of the Codex Theresianus. Moreover this is a series of descriptions about civil laws, valid for different hereditary provinces of the Habsburg Monarchy, which should then serve as basic sources in regard of the project of an unified Civil Code, which was provided as a common law for the entire monarchy instead of particular laws in different provinces. In his edition of the Codex Theresianus Harrasowsky specified only the headlines of Azzonis "plan"; he also presented several descriptions of the Civil Law, valid for the particular hereditary provinces, namely in annotations to the content of the Codex; however only regarding details, and sporadically distributed within the three parts of the Codex.
Since the times of Harrasowsky, legal historical research has not been interested in these eldest materials about the history of the Austrian General Civil Code. Only since World Word II literature in legal history is showing a few references to these materials, of course not in a comprehensive matter or in regard of specific questions dealing with certain contents of specific text modules. Among all these materials only the description of Holger remained entirely in the archive of the Ministry of Justice. About 75 % of these documents treasured in this archive, were completely destroyed due to the fire-disaster in 1927 - as just mentioned at the begin of this lecture.
A considerable part of records and files of course was salvaged, but partly seriously damaged by fire and water. Among the eldest preparatory works on the Codex Theresianus - except of Holgers illustration of the contemporary Austrian law - furthermore only Azzonis preliminary draft was kept in existence. Not to mention that both documents are showing remarkable marks of the disaster of 1927, nevertheless these damages are not extensive, and this was leading to the allowance of Austrian Archive of Administration, where these documents are actually preserved, to use them for the purpose of an edition.

Abstract

Esta publicación ofrece una antología representativa de ensayos, escritos en el arco de treinta años, destinados a ilustrar luces y sombras del proceso codificador. El autor ve en éste no sólo una reorganización formal de la materia jurídica (penal, civil, mercantil o procesal) destinada a garantizar certeza, y por ello dirigida a conseguir mayor completitud material, sino también (y sobre todo) la visible repercusión jurídica de un cambio político, social, cultural, económico, es decir –simplificando– de la transición del mundo feudal al burgués. Por este motivo, la codificación deviene la estrategia jurídica preferida para corresponder a las aspiraciones incubadas por la sociedad en el contexto posrevolucionario. Se examina por eso desde perspectivas distintas: locales (la mayoría referidas al microcosmo suizo) y supranacionales, formales y materiales, científicas y presapienciales. El autor raramente se contenta con razonamientos basados en datos normativos, en reglas jurídicas promulgadas por los códigos. Tiende más bien a preguntarse sobre como la nueva sociedad burguesa recibió el nuevo derecho del código, sobre como lo ha aprovechado en sus propios programas, sobre los fines concretos de esta descontada adaptación normativa. Por este motivo, al privilegiar siempre la interpretación del destinatario, el autor no cede a la tentación de escribir una historia continental de la codificación, sino que prefiere un examen más pegado a la realidad histórica concreta de las singulares sociedades que codifican. Y lo hace en el espíritu de la intuición de Montesquieu, según la cual “c’est un très grand hasard, si les lois d’une nation peuvent convenir à une autre”.

Abstract

A study of the (incomplete) draft of the Civil Code drawn up by the Cortes in 1821, within the framework of the ideas and texts of the contemporary European codification. It reconstructs the parliamentary life of the text in the Spanish Cortes and the biographies of the deputies who worked on it, in particular Nicolás Mª Garelly. The analysis of three relevant issues addressed by Garelly and his colleagues – namely the theory of legislation, the conditions affecting the legal status of individuals, their civil rights - completes the monograph, which also includes a new edition of the printed booklet (December 1821) that constitutes our sole source of knowledge. --- Estudio del (incompleto) proyecto de Código civil elaborado por las Cortes en 1821, en el marco de las ideas y textos de la codificación civil europea del momento y de la Constitución de 1812. Se reconstruye la vida parlamentaria del intento de las Cortes y las biografías de los diputados que estuvieron tras su elaboración, en particular el valenciano Nicolás Mª Garelly. El análisis de tres relevantes cuestiones abordadas por Garelly y sus colegas –la teoría de la ley, las condiciones que afectaban el estatuto jurídico de los individuos, los derechos civiles de éstos− completa la monografía, que incluye una nueva edición del folleto impreso (en diciembre de 1821) que constituye nuestra única fuente de conocimiento.

Abstract

This book focuses on the development of the law of conspiracy in England from the thirteenth to the early eighteenth century. The historiography of the law of conspiracy has adopted an unmistakably doctrinal approach to this topic which has produced a treasure trove of legal sources. By borrowing concepts from cognitive linguistics, this research will shed light upon new aspects of these sources that the doctrinal approach could not reveal. It will show how certain conducts were lexicalized as a conspiracy in the Middle Ages. It will also show how these terms are involved in the lexicalization of the crime of treason and how through a process of conceptual blending the action upon the case in the nature of conspiracy rose as an action separate from the medieval conspiracy. Finally, it will be seen how the modern offense of conspiracy emerged out of the process of conceptual blending through analogies with treason and the action upon the case in the nature of conspiracy.------ Este libro se centra en la genealogía del delito de conspiración en Inglaterra desde el siglo XIII hasta comienzos del XVIII. La historiografía acerca del mismo ha sido de carácter marcadamente doctrinal, aunque ha producido un valioso acopio de fuentes. Haciendo uso de conceptos de la lingüística cognitiva, esta investigación revela aspectos de la genealogía del concepto de conspiración que el enfoque doctrinal no podía percibir. Se muestra cómo ciertas conductas fueron lexicalizadas como conspiración en la Edad Media, cómo el mismo término aparece en la conceptualización del delito de traición y cómo a través de un proceso de integración conceptual se produjo la action upon the case in the nature of conspiracy diferente de la conspiración medieval. Finalmente, también se verá cómo el moderno sentido de conspiración surgió a través del mismo proceso de integración conceptual que permitía establecer analogías con el delito de traición, así como con la action upon the case in the nature of conspiracy.
