Abstract

Wissenschaft meint seit jeher nicht nur theoretische Reflexion, sondern immer auch gesellschaftliche Praxis. Heute steht diese Praxis, die Welt der modernen Wissenschaften und ihrer institutionellen Formen mitten im Strom tiefgreifender Veränderungen – Exzellenzinitiativen und Clusterbildung, Studiengebührenfinanzierung und Bologna-Prozess, Wettbewerbsstrukturen, Globalhaushalte und externe Management-Maßstäbe sind hierfür nur einige illustrierende Schlagworte. Den Handlungsdrang der deutschen Hochschulpolitik im Blick gerät naturgemäß auch das Wissenschaftsrecht in Bewegung. Fragen seiner verfassungsrechtlichen Grundierung und seiner verwaltungsrechtlichen Feinzeichnung sind so umstritten wie lange nicht. Das Leitmotiv, ob das heutige Wissenschaftsrecht in erster Linie dem Schutz der individuellen Forschungsleistungen einzelner Wissenschaftlerinnen und Wissenschaftler dient oder ein Baukasten zur Modernisierung der Hochschulen ist, führt wiederkehrend zu den Grundfragen des modernen Öffentlichen Rechts. Diese Entwicklungen vor Augen beging das Institut für Öffentliches Recht an der Juristischen Fakultät der Georg-August-Universität Göttingen seine Neugründung mit einer Arbeitstagung zum Thema „Aktuelle Probleme des Wissenschaftsrechts“. Die Beiträge der Tagung enthält dieser Band. Er ist der erste einer neuen Schriftenreihe zum Öffentlichen Recht.

Abstract

Australia lacks a scholarly book that covers recent developments in public sector governance in Australia and blends cross-disciplinary perspectives from law, management, public administration and public policy. The primary reason for writing this book is to fill the gap in the treatment of this subject, and to provide insights from empirical evidence and current practice. The book provides the first comprehensive theoretical and empirical work on governance in the Commonwealth public sector. It addresses the issues that emerged under the Howard government as well as their handling under the Rudd and Gillard governments. The book aims to enhance understanding of and communication about public governance across government, industry and the community. The authors bring to this book expertise gained from political science, public administration and policy, public and private sector law.

Abstract

The field of public participation is developing fast, with phenomena such as citizen science and crowdsourcing extending the resource base of research, stimulating innovation and making science more accessible to the general population. Promoting public participation means giving more weight to citizens and civil society actors in the definition of research needs and in the implementation of research and innovation. As yet, there is limited understanding of the implications of widespread use of public participation and as a result, there is a risk that it will become a burden for research and an obstacle to bridging the gap between research and society. This volume presents the findings of a three-year international study on innovative public participation. The resulting work studies the characteristics and trends of innovative public participation through a global sample of 38 case studies. It provides theoretical generalisations on the dynamics of public participation, suggestions for an evaluation framework and clear empirical examples of how public participation works in practice. Illustrated by best practice cases, the authors identify characteristics which contribute to successful public participation. The book is aimed primarily at scholars and practitioners of public participation, as well as research managers, policy makers and business actors interested in related issues. There is also a secondary market for students and scholars of European governance studies, sociology and political sciences.

Abstract

Le vote et la mise en œuvre de la loi organique relative aux lois de finances du 1er août 2001 ont rappelé l’importance de la régulation et de la gestion des finances publiques. Pour ses promoteurs, la LOLF introduirait de manière inédite des préoccupations managériales dans le droit budgétaire et comptable, volontiers présenté comme peu soucieux de considérations d’efficacité ou d’efficience. Cette actualité de la LOLF incite l’historien, le juriste ou le politiste à prendre de la distance en réinscrivant ces mutations dans la longue durée. À travers une série d’études inédites, cet ouvrage retrace l’histoire mal connue des principes, des règles, des instruments et des pratiques qui ont façonné le droit budgétaire et compta ble tout au long du XIXe siècle, depuis sa refondation sous la Restauration jusqu’au début de la Première Guerre mondiale. Comment et à travers quels enjeux sont produites les normes du droit budgétaire et comptable ? Quels débats de doctrine suscitentelles ? Que nous apporte la perspective historique pour (re)penser les relations entre la mise en place d’un droit des finances publiques et les préoccupations gestionnaires ? Abstract

In this evidence-based and closely argued work, Kathy MacDermott plots the changes in the culture of the Australian Public Service that have led many contemporary commentators to lament the purported loss of traditional public service values of impartiality, intellectual rigour and — most importantly — the willingness of public servants at all levels to offer frank and fearless advice to their superiors and their ministers. MacDermott brings to her analysis an insider’s sensibility and a thorough forensic analysis of the impact of some 20 years of relentless administrative ‘reform’ on the values and behaviour of the APS. Although this story has its beginnings in the Hawke-Keating eras, MacDermott convincingly argues that structural and cultural change compromising the integrity of the public service reached its apogee towards the end of the eleven years of the Howard government. This is a ‘must read’ for students of Australian political and administrative history. MacDermott offers cautionary observations that the new national government might do well to heed.

Abstract

In July 2012 historians and economists met in Paris for a conference entitled State Cash Resources and State Building in Europe: taxation and public debt, 13th-18th centuries. This volume is one of the products of that meeting. By making these essays available in both French and English translations, the editors hope to ensure a wide audience for an important set of contributions on questions relating to the development and management of public finance and its connection with the growth and power of the early modern state. Contributors were asked to consider three major themes in their essays: first, the choices that faced states seeking to raise funds and, in particular, questions of how to balance taxation and borrowing. Second, contributors were asked to explore the connections between political regime and finance. This included the much-explored question of whether particular regimes were more effective at raising funds and were viewed as more reliable borrowers but the essays also ask how the rights of creditors were enforced and how creditors monitored those to whom they lent money. The final theme concerned the primary and secondary markets in state debt and here the contributors focused on questions of liquidity, transparency and the skills of those who traded and manipulated the instruments of the state’s debt. The resulting essays offer a comparative perspective over six centuries of European history. Taken together they provide a rich new resource and challenge both the neat dichotomies that have been drawn between absolutist and constitutional states and entrenched ideas about how practice evolved and knowledge and skills were shared and transferred between actors and states.

Abstract

Cet ouvrage présente, dans une perspective comparatiste et sur la longue durée, les moyens de mobilisation des ressources publiques des États médiévaux et modernes, dont les besoins de fonds sont accrus par les guerres. Couvrant six siècles de l’histoire de l’Europe occidentale, les contributions étudient les transformations des méthodes de financement (émission monétaire, fiscalité, emprunt public à court ou long terme, forcé ou volontaire, vente d’offices) et les institutions, les acteurs, les marchés primaire et secondaire des titres de dette. Elles interrogent les modèles d’organisation politique et leurs interactions avec le drainage efficace de l’argent, la construction d’une information statistique, financière et fiscale et ses conséquences sur la prise de décision des gouvernants. Elles invitent à examiner l’impact des innovations financières, les différents modes d’anticipation des ressources et les effets macro­économiques des mécanismes de mobilisation de la richesse privée. Elles explorent l’influence de déterminants tels que les dimensions spatiales des États, les régimes politiques, l’inégale distribution des richesses, l’utilisation du privilège, les différents degrés de risque imposés aux prêteurs, pour expliquer comment et pourquoi un mode de financement l’emporte ici et non ailleurs.
