Abstract

This chapter differs from others in this monograph in its focus on two political organisations, the EU and the COE, and their top-down efforts to engage with issues of heritage and identity. These organisations represent the two most visible post-1945 political efforts to transform Europe as a region, by promoting further integration; both are driven by a fluid collective memory of the impact made by world wars, genocide, economic deprivation and other forms of societal disruption. By their very nature, both organisations have sought to engage with the construction and reconstruction of history and identity, both to pursue a vision of a common Europe and to build a sense of purpose and value in their organisational efforts to build integration (and therefore justify their existence). They have selected particular policy instruments, which Hood (1983) defines as the tools by which actors implement their governance strategies. The core research question is: how do these two institutions seek to intervene and make people engage with memories, histories and identities by creating cultural heritage institutions and instruments?

Abstract

This chapter takes an interdisciplinary approach to the subject of memorialization and commemoration, protest and populism in relation to the performative enacting and official presentation of difficult history. It analyzes the various actors instrumentalizing the same dark heritage in different ways, by different means, and for different purposes, to draw conclusions about processes of coming to terms with the past ( Vergangenheitsbewältigung ) in relation to the contemporary context of populism and migration.

Abstract

This book analyzes issues in human rights law from a variety of perspectives by eminent European and Asian professors of constitutional law, international public law, and European Union law.As a result, their contributions collected here illustrate the phenomenon of cross-fertilization not only in Europe (the EU and its member states and the Council of Europe), but also between Europe and Asia. Furthermore, it reveals the influence that national and foreign law, EU law and the European Convention on Human Rights, and European and Asian law exert over one another.The various chapters cover general fundamental rights and human rights issues in Europe and Asia as well as specific topics regarding the principles of nondiscrimination, women’s rights, the right to freedom of speech in Japan, and China’s Development Banks in Asia.Protection of human rights should be guaranteed in the international community, and research based on a comparative law approach is useful for the protection of human rights at a higher level. As the product of academic cooperation between ten professors of Japanese, Taiwanese, German, Italian, and Belgian nationalities, this work responds to such needs.

Abstract

This paper assesses coordination as a salient capability of international interventions in complex settings characterised by weak states, the dominance of political elites whose interest in reforms is questionable and multiple local and international stakeholders. It focuses on the challenge of integrating a range of national and international actors and multiple policy domains, assessing this operational capability in terms of a Whole-of-Society approach. Using the example of the EU’s intervention in Kosovo through the mechanisms of the EULEX mission, and the EU-facilitated Dialogue between Serbia and Kosovo, the paper argues that the EU’s impact in Kosovo was weakened by its limited ability to include and engage a broad range of local stakeholders. While a Whole-of-Society approach could address this weakness, the paper also argues that a better understanding of the context-specific opportunities and limitations placed on international organisations like the EU is needed.

Abstract

"“Unintended consequences” is an umbrella concept. It comprises phenomena that differ in crucial respects and consequently, without refinement, it remains a rather blunt instrument for policy analysis. The contributions in this volume, however, show that disentangling unintended consequences by making clear distinctions between various types, makes the concept much more useful for policy analysis. Assessing the impact of EU foreign policies as studied in this volume, we show that “bonuses”, “windfalls”, “accidents”, and “trade-offs” – all unintended – are very different when it comes to the explanation of policy outcomes, or to allocating responsibility for them."

Abstract

The book analyses the attitudes of non-EU countries towards European integration in historical and contemporary perspectives. The authors study a range of actors in Europe and beyond to explain the impact of the creation of the European Communities on the international system and how the EU is perceived in the world. The book further shows the significance of the institutional interplay within the EU, and between EU institutions, member states and external actors led by their own internal dynamics to explain policy outcomes. It investigates to what extent the perceptions of the international community towards the European Communities and the EU have been influenced by the complexity of their decision-making and the difficulty of reconciling the views of member states on key external relations issues. The authors also study the interplay of non-EU countries and the EU within the broader context of international and regional institutions and forums for international cooperation.

Abstract

The information and risk society poses a new challenge for the law in all its fragments. Modern media communication and technologies increase people’s prosperity while stating new risks with not uncommonly devastating crisis-potential: The banking crisis, the safety net for the euro zone and the nuclear incident in Fukushima are only the latest forms of those specific modern common dangers which the law is facing – in many cases due to it’s domestically limited validity - not or not sufficiently prepared. In order to promote the international dialog within the jurisprudence there was a conference in October 2010 held by the faculty of law of the Georg-August-Universität, supported by the chair of GAU, together with the faculty of Seoul National University School of Law discussing main issues of law in a modern information and risk society. With this volume the results of this convention shall be made accessible to everybody interested. Thereby it illustrates not only the variety of new issues and aspects, but also reveals that this can only be the beginning on the way to a deeper understanding of the complex correlations. Volume 10 in the series „Göttinger Juristische Schriften“ The series is published by the Faculty of Law of the Georg-August-Universität Göttingen und makes events at the faculty publicly available.

Abstract

This chapter highlights the relevance of text categorisation for research in legal translation by focusing on institutional translation settings, namely: the European Union (EU), the United Nations (UN) and the World Trade Organization (WTO), and their corresponding adjudicative bodies.1 After briefly reviewing recurrent issues and models of legal text classification (section 2), a multidimensional approach is applied to the multilingual text production of the three representative institutional translation settings during three years over the span of a decade (2005, 2010 and 2015), as part of the project “Legal Translation in International Institutional Settings: Scope, Strategies and Quality Markers” (LETRINT) (section 3). The resulting subdivisions are integrated into a categorisation matrix and discussed as a way of illustrating the relative nature and implications of text classifications. The fine-grained description of corpus design and representativeness, technical aspects of corpus compilation and full taxonomies of genres are not addressed in this chapter.
