Abstract

Abstract

Does gender condition politicians’ discourse strategies in parliament? This is the question we try to answer in A Gender-based Approach to Parliamentary Discourse: The Andalusian Parliament. This book, written by experts in the field of discourse analysis, covers key aspects of political discourse such as gender, identity and verbal and nonverbal strategies: intensification, enumerative series, non-literal quotations, pseudo-desemantisation, lexical colloquialisation, emotion, eye contact and time management. Abstract

Eight disputations on precedence have been preserved from Ancient Mesopotamia. In these texts, two opposing understandings of everyday life engage in a verbal argument. The works served at one time to teach oratorical competency to individuals receiving advanced literacy training. This volume examines the argumentation structure of the dialogues, thereby contributing to research on oratorical practice in the Ancient Middle East.

Abstract

We are pleased to release this digital edition of Ralph Johnson’s The Rise of Informal Logic as Volume 2 in the series Windsor Studies in Argumentation. This edition is a reprint of the previous Vale Press edition with some minor corrections.We have decided to make this the second volume in the series because it is such a compelling account of the formation of informal logic as a discipline, written by one of the founders of the field. The book includes essential chapters on the history and development of informal logic. Other chapters are key reflections on the theoretical issues raised by the attempt to understand informal argument. Many of the papers were previously published in important journals. A number of them were co-authored with J. Anthony Blair. Three of them have appeared only in the present book.

Grâce au Digeste de Justinien, les œuvres des juristes romains ont constitué le droit en vigueur dans de nombreux pays d’Europe, du xie au xixe siècle. Mais ces écrits ont suscité plus d’intérêt pour leur contenu juridique que pour leurs qualités littéraires. D’où cette question initiale : Les juristes romains étaient-ils des écrivains ? Leurs œuvres constituent-elles une littérature ? S’appuyant sur une documentation riche et variée, l’auteur propose, dans une approche au croisement du droit, de la philologie et de l’histoire, de redonner une place à cette « littérature invisible ». Soumettre les écrits des juristes aux méthodes et questions habituellement réservées aux œuvres littéraires permet d’identifier les nombreux liens que la pensée juridique a établis avec les autres domaines de la culture antique afin de parvenir à une résolution équitable des conflits grâce à l’argumentation. Partant du point de vue des lecteurs antiques, l’ouvrage présente trois attitudes que le juriste pouvait adopter dans sa pratique : celle du philosophe, de l’historien ou de l’enseignant. Cet ouvrage est issu d’un cycle de conférences dispensées au Collège de France.

Este libro contiene el Arte breve de la invención del derecho, la traducción al español de Ars brevis quae est de inventione iuris, la última obra de Ramon Llull dedicada a la aplicación de su Arte al derecho, escrita en 1308. En esta obra, tal y como sostiene Rafael Ramis Barceló en el Estudio Preliminar a la misma, Llull intentó transformar, hasta cierto punto, su Arte en una teoría de la argumentación, adoptando tanto conceptos de la filosofía aristotélica como algunos casos de derecho civil y canónico procedentes del acervo del ius commune. El interés de este tratado luliano radica, entre otras muchas cosas, en la exposición de un método jurídico radicalmente distinto del que cultivaban los legistas y canonistas de su época, y que era capaz de mostrar algunas de las debilidades epistemológicas y argumentativas del saber jurídico y de su enseñanza a comienzos del siglo XIV. = This book contains Arte breve de la invención del derecho, the translation into Spanish of Ars brevis quae est inventione iuris, the last work written by Raimundus Lullus dedicated to the application of his Art to the Law (1308). In this work, according to the Preliminary Study written by Rafael Ramis Barceló, Llull sought to transform, to some extent, his Art on a theory of argumentation, using concepts from the Aristotelian philosophy as some cases of civil and canon law from the ius commune. The interest of this Lullian treatise is based, among other things, on the exhibition of a legal method radically different from the methodology of lawyers and canonists of his time. And Lullus’ method was able to show some of the epistemological and argumentative weaknesses of legal knowledge and of teaching of Law in the early fourteenth century.
