Abstract

This chapter differs from others in this monograph in its focus on two politicalorganisations, the EU and the COE, and their top-downefforts to engage withissues of heritage and identity. These organisations represent the two mostvisible post-1945political efforts to transform Europe as a region, by promotingfurther integration; both are driven by a fluid collective memory of the impactmade by world wars, genocide, economic deprivation and other forms of societaldisruption. By their very nature, both organisations have sought to engage withthe construction and reconstruction of history and identity, both to pursue avision of a common Europe and to build a sense of purpose and value in theirorganisational efforts to build integration (and therefore justify their existence). They have selected particular policy instruments, which Hood (1983) defines asthe tools by which actors implement their governance strategies. The coreresearch question is: how do these two institutions seek to intervene and makepeople engage with memories, histories and identities by creating cultural heritageinstitutions and instruments?

Abstract

This paper assesses coordination as a salient capability of internationalinterventions in complex settings characterised by weakstates, the dominance of political elites whose interest in reformsis questionable and multiple local and international stakeholders. It focuses on the challenge of integrating a range of national andinternational actors and multiple policy domains, assessing thisoperational capability in terms of a Whole-of-Society approach.Using the example of the EU’s intervention in Kosovo throughthe mechanisms of the EULEX mission, and the EU-facilitatedDialogue between Serbia and Kosovo, the paper argues that theEU’s impact in Kosovo was weakened by its limited ability toinclude and engage a broad range of local stakeholders. While aWhole-of-Society approach could address this weakness, the paperalso argues that a better understanding of the context-specificopportunities and limitations placed on international organisationslike the EU is needed.

Abstract

"“Unintended consequences” is an umbrella concept. It comprisesphenomena that differ in crucial respects and consequently, withoutrefinement, it remains a rather blunt instrument for policyanalysis. The contributions in this volume, however, show thatdisentangling unintended consequences by making clear distinctionsbetween various types, makes the concept much more usefulfor policy analysis. Assessing the impact of EU foreign policies asstudied in this volume, we show that “bonuses”, “windfalls”, “accidents”,and “trade-offs” – all unintended – are very different whenit comes to the explanation of policy outcomes, or to allocatingresponsibility for them."

Abstract

This chapter highlights the relevance of text categorisation for research in legaltranslation by focusing on institutional translation settings, namely: the EuropeanUnion (EU), the United Nations (UN) and the World Trade Organization(WTO), and their corresponding adjudicative bodies.1 After briefly reviewingrecurrent issues and models of legal text classification (section 2), a multidimensionalapproach is applied to the multilingual text production of the threerepresentative institutional translation settings during three years over the spanof a decade (2005, 2010 and 2015), as part of the project “Legal Translationin International Institutional Settings: Scope, Strategies and Quality Markers”(LETRINT) (section 3). The resulting subdivisions are integrated into a categorisationmatrix and discussed as a way of illustrating the relative nature and implicationsof text classifications. The fine-grained description of corpus design andrepresentativeness, technical aspects of corpus compilation and full taxonomies ofgenres are not addressed in this chapter.

Abstract

"Unintended consequences arising from EU external migration policyare a result of the multi-actor nature of this policy and of policyinteractions. In addition, scholars face serious methodological challengesin establishing what the EU’s ‘intent’ is in external migrationpolicy and, therefore, in determining which consequences areintended and which are unintended. The literature on the implementationand evaluation of EU external migration policy is in its infancy, and future work should take into account all policy outcomes – boththose that were intended and those that were not."

Abstract

"There is a gap in IR and EU scholarship concerning unintendedconsequences in an international context, leaving this importantphenomenon understudied. To fill this gap, a conceptualisation ofunintended consequences is offered, and a set of commonresearch questions are presented, highlighting the nature (what),the causes (why) and the modes of management (how) of unintendedconsequences of EU external action. The Special Issuecontributes to the study of the EU as an international actor bybroadening the notion of the EU’s impact abroad to include theunintended consequences of EU (in)actions and by shedding newlight on the conceptual paradigms that explain EU external action."

Abstract

Drawing on new research material from ten European countries, Asylum Determination in Europe: Ethnographic Perspectives brings together a range of detailed accounts of the legal and bureaucratic processes by which asylum claims are decided. The book includes a legal overview of European asylum determination procedures, followed by sections on the diverse actors involved, the means by which they communicate, and the ways in which they make life and death decisions on a daily basis. It offers a contextually rich account that moves beyond doctrinal law to uncover the gaps and variances between formal policy and legislation, and law as actually practiced. The contributors employ a variety of disciplinary perspectives – sociological, anthropological, geographical and linguistic – but are united in their use of an ethnographic methodological approach. Through this lens, the book captures the confusion, improvisation, inconsistency, complexity and emotional turmoil inherent to the process of claiming asylum in Europe.

Abstract

Providing original insights into the factors causing early job insecurity in European countries, this book examines its short- and long-term consequences. It assesses public policies seeking to diminish the risks to young people facing prolonged job insecurity and reduce the severity of these impacts. Based on the findings of a major study across nine European countries, this book examines the diverse strategies that countries across the continent use to help young people overcome employment barriers.

Abstract

The existing literature on state-building has focused mainly onpost-conflict cases and ‘conventional’ examples of statehood, without taking into consideration the particularities of states thatremain internally and/or externally contested. The EU’s engagementin Palestinian state-building through the deployment ofEUPOL COPPS and EUBAM Rafah has generated various types ofunintended consequences: anticipated and unanticipated, positiveand negative, desirable and undesirable, some of which fulfill andsome of which frustrate the initial intention. These have importantreverberations for the EU’s conflict resolution strategies in Israeland Palestine, the most important being the strengthening ofpower imbalances and the enforcement of the status quo.
