Abstract

The Constitution of the Democratic Republic of Timor-Leste of 2002 contains over 40 human rights provisions in its Bill of Rights. In addition to providing an overview of the process leading up to the adoption of the Constitution, this book brings together information relating to each section of the Bill of Rights, presenting: progressive texts produced during the process of the Constituent Assembly; highlights of the arguments put forward within the Constituent Assembly concerning the draft provisions, including alternative proposals advanced; submissions made by Timorese officials, civil society and international bodies; and the results of consultation with the broader community before and during the constitutional process. It is designed to be useful in particular to judges and legal practitioners called upon to interpret the Constitution, government officials and civil society actors involved in human rights work, as well as students of history and constitutional law in Timor-Leste and internationally.

Abstract

This book examines the emerging trend of requests for expert opinions in asylum hearings or refugee status determinations. It is the first to explore the role of court-based expertise in relation to African asylum cases and the first to establish a rigorous analytical framework for interpreting the effects of this new reliance on expert testimony. Courts in Western countries and beyond have begun demanding expert reports tailored to the experience of the individual claimant. As courts increasingly draw upon such testimony in their deliberations, expertise in matters of asylum and refugee status is emerging as an academic area with its own standards, protocols, and guidelines.

“Dilemas, apuestas y reflexiones teórico-metodológicas para los abordajes en Historia Reciente” se preocupa por presentar los dilemas teóricos y metodológicos, las potencialidades  y la utilización de las fuentes para la escritura de la Historia Reciente, los condicionantes en las agendas académicas con el propósito de dejar explicitadas las preocupaciones con las que se trabaja en escritura de la historia del pasado reciente y dar cuenta cómo se construyen los objetos de estudio. El libro está organizado en dos partes. La primera dedicada a discutir conceptos, categorías y perspectivas teóricas, y la segunda orientada a reflexionar sobre posibilidades y limitaciones del heterogéneo y complejo universo de materiales utilizados en la escritura de los diferentes capítulos de ese pasado doloroso y que no pasa. No obstante esta división, los recorridos analíticos, teórico-metodológicos e historiográficos atraviesan todos los capítulos del libro, pero lo hacen desde aproximaciones disímiles, que aportan de manera significativa, sea a la reflexión crítica sobre cuestiones estructurantes de la investigación sobre el pasado reciente (la represión, sus dimensiones, modalidades y características; la militancia humanitaria, las relaciones entre violencia y política, los exilios; la temporalidad del pasado-presente; los trabajos de la memoria, la transmisión intergeneracional de pasados traumáticos), sea al conocimiento específico de capítulos concretos de la historia de las dictaduras argentina y chilena.

Abstract

One of the most troubling but least studied features of mass political violence is why mass violence often recurs in the same place over long periods of time. Douglas Kammen explores this pattern in Three Centuries of Conflict in East Timor, studying East Timor’s tragic past, and focusing on the small district of Maubara. This book combines an archival trail and rich oral interviews to reconstruct the history of the leading families of Maubara from 1712 until 2012.

Abstract

Challenges to security and human rights involving extractive and other industries are addressed in a framework known as business and human rights (BHR), which shares many challenges and goals with SSR. This paper describes the grounds where BHR and SSR coincide in principles, actors and activities and which synergies can be built on that base. Opportunities for bridging BHR and SSR are drawn from a systematic comparison of case studies on Guinea, Colombia and Papua New Guinea. BHR and SSR should ideally cohere instead of collide.&#xD;

Abstract

Fundamental rights for all people with disabilities, education and employment are key for the inclusion of people with autism. They play as facilitators for the social inclusion of persons with autism and as multipliers for their enjoyment of other fundamental rights. After outlining the international and European dimensions of the legal protection of the rights to education and employment of people with autism, the book provides an in-depth analysis of domestic legislative, judicial and administrative practice of the EU Member States in these fields. Each chapter identifies the good practices on inclusive education and employment of people with autism consistent with principles and obligations enshrined in the UN Convention on the Rights of Persons with Disabilities (Articles 24 and 27).The book contains the scientific results of the European Project “Promoting equal rights of people with autism in the field of employment and education” aimed at supporting the implementation of the UN Convention in the fields of inclusive education and employment.

Abstract

This action research jointly undertaken by the Center for Conflict Manage-ment in Butare and the Haute Ecole de Travail Social in Geneva aims at analysing and supporting pilot experiences by community actors in post-genocide Rwanda. Such experiences are analysed through dialogs involving field actors, Rwandan and Swiss researchers. Special attention is paid to managing conflicts related to identity and memory and rebuilding social solidarity among citizens. Expected benefits include training of field actors and those involved in reconciliation work in general.
