Abstract

This chapter differs from others in this monograph in its focus on two political&#xD;organisations, the EU and the COE, and their top-down&#xD;efforts to engage with&#xD;issues of heritage and identity. These organisations represent the two most&#xD;visible post-1945&#xD;political efforts to transform Europe as a region, by promoting&#xD;further integration; both are driven by a fluid collective memory of the impact&#xD;made by world wars, genocide, economic deprivation and other forms of societal&#xD;disruption. By their very nature, both organisations have sought to engage with&#xD;the construction and reconstruction of history and identity, both to pursue a&#xD;vision of a common Europe and to build a sense of purpose and value in their&#xD;organisational efforts to build integration (and therefore justify their existence).&#xD;They have selected particular policy instruments, which Hood (1983) defines as&#xD;the tools by which actors implement their governance strategies. The core&#xD;research question is: how do these two institutions seek to intervene and make&#xD;people engage with memories, histories and identities by creating cultural heritage&#xD;institutions and instruments?

Abstract

This paper assesses coordination as a salient capability of international&#xD;interventions in complex settings characterised by weak&#xD;states, the dominance of political elites whose interest in reforms&#xD;is questionable and multiple local and international stakeholders.&#xD;It focuses on the challenge of integrating a range of national and&#xD;international actors and multiple policy domains, assessing this&#xD;operational capability in terms of a Whole-of-Society approach.&#xD;Using the example of the EU’s intervention in Kosovo through&#xD;the mechanisms of the EULEX mission, and the EU-facilitated&#xD;Dialogue between Serbia and Kosovo, the paper argues that the&#xD;EU’s impact in Kosovo was weakened by its limited ability to&#xD;include and engage a broad range of local stakeholders. While a&#xD;Whole-of-Society approach could address this weakness, the paper&#xD;also argues that a better understanding of the context-specific&#xD;opportunities and limitations placed on international organisations&#xD;like the EU is needed.

Abstract

"“Unintended consequences” is an umbrella concept. It comprises&#xD;phenomena that differ in crucial respects and consequently, without&#xD;refinement, it remains a rather blunt instrument for policy&#xD;analysis. The contributions in this volume, however, show that&#xD;disentangling unintended consequences by making clear distinctions&#xD;between various types, makes the concept much more useful&#xD;for policy analysis. Assessing the impact of EU foreign policies as&#xD;studied in this volume, we show that “bonuses”, “windfalls”, “accidents”,&#xD;and “trade-offs” – all unintended – are very different when&#xD;it comes to the explanation of policy outcomes, or to allocating&#xD;responsibility for them."&#xD;

Abstract

This chapter highlights the relevance of text categorisation for research in legal&#xD;translation by focusing on institutional translation settings, namely: the European&#xD;Union (EU), the United Nations (UN) and the World Trade Organization&#xD;(WTO), and their corresponding adjudicative bodies.1 After briefly reviewing&#xD;recurrent issues and models of legal text classification (section 2), a multidimensional&#xD;approach is applied to the multilingual text production of the three&#xD;representative institutional translation settings during three years over the span&#xD;of a decade (2005, 2010 and 2015), as part of the project “Legal Translation&#xD;in International Institutional Settings: Scope, Strategies and Quality Markers”&#xD;(LETRINT) (section 3). The resulting subdivisions are integrated into a categorisation&#xD;matrix and discussed as a way of illustrating the relative nature and implications&#xD;of text classifications. The fine-grained description of corpus design and&#xD;representativeness, technical aspects of corpus compilation and full taxonomies of&#xD;genres are not addressed in this chapter.

Abstract

"Unintended consequences arising from EU external migration policy&#xD;are a result of the multi-actor nature of this policy and of policy&#xD;interactions. In addition, scholars face serious methodological challenges&#xD;in establishing what the EU’s ‘intent’ is in external migration&#xD;policy and, therefore, in determining which consequences are&#xD;intended and which are unintended. The literature on the implementation&#xD;and evaluation of EU external migration policy is in its infancy,&#xD;and future work should take into account all policy outcomes – both&#xD;those that were intended and those that were not."&#xD;

"There is a gap in IR and EU scholarship concerning unintended&#xD;consequences in an international context, leaving this important&#xD;phenomenon understudied. To fill this gap, a conceptualisation of&#xD;unintended consequences is offered, and a set of common&#xD;research questions are presented, highlighting the nature (what),&#xD;the causes (why) and the modes of management (how) of unintended&#xD;consequences of EU external action. The Special Issue&#xD;contributes to the study of the EU as an international actor by&#xD;broadening the notion of the EU’s impact abroad to include the&#xD;unintended consequences of EU (in)actions and by shedding new&#xD;light on the conceptual paradigms that explain EU external action."&#xD;

Abstract

The existing literature on state-building has focused mainly on&#xD;post-conflict cases and ‘conventional’ examples of statehood,&#xD;without taking into consideration the particularities of states that&#xD;remain internally and/or externally contested. The EU’s engagement&#xD;in Palestinian state-building through the deployment of&#xD;EUPOL COPPS and EUBAM Rafah has generated various types of&#xD;unintended consequences: anticipated and unanticipated, positive&#xD;and negative, desirable and undesirable, some of which fulfill and&#xD;some of which frustrate the initial intention. These have important&#xD;reverberations for the EU’s conflict resolution strategies in Israel&#xD;and Palestine, the most important being the strengthening of&#xD;power imbalances and the enforcement of the status quo.

Bankenstrukturreformen, die eine Trennung von Investment- und Retailbanking vorsehen und die zusammenfassend als „Ring-Fencing“ bezeichnet werden können, werden seit der Finanzkrise kontrovers diskutiert. Die Arbeit befasst sich mit den rechtlichen Entwicklungen in der Europäischen Union sowie mit Regelungen im Vereinigten Königreich, Deutschland und der Schweiz.Die Arbeit trägt zur Abgrenzung und der Systematik von Ring-Fencing-Regelungen bei und zeichnet ein umfassendes Bild der gegenwärtigen Entwicklungen sowie möglicher Perspektiven auf Ebene des Unionsrechts. Darüber hinaus untersucht sie strukturelle Unterschiede zwischen bestehenden nationalen Regelungen an Europas drei wichtigsten Finanzplätzen und geht dabei insbesondere auf die einzigartigen aber bisher international wenig beachteten Schweizerischen Ring-Fencing-Bestrebungen ein.Die Arbeit wurde unter anderem mit dem Österreichischen Preis für Insolvenzrecht ausgezeichnet.Bank structural reforms that stipulate the separation of retail and investment banking and that can collectively be referred to as ‘ring-fencing’ have been among the most controversial regulations since the financial crisis. This study explores legal developments in the European Union in this regard as well as national legislation in the United Kingdom, Germany and Switzerland.The study contributes to the terminology and classification of existing and future ring-fencing initiatives and paints a comprehensive picture of current developments and prospects on an EU level in this respect. It furthermore highlights structural differences in the national approaches of Europe’s three most important financial centres, and casts light on Switzerland’s unique ring-fencing efforts that have been barely recognised internationally.This study was recognised with the Austrian Award for Insolvency Law.
