Abstract

This book is about trials, civil and criminal, ecclesiastical and secular, in England and Europe between the thirteenth and the seventeenth centuries. The opening chapter provides a conceptual framework both for this book and for its companion volume on the eighteenth, nineteenth and twentieth centuries. Subsequent chapters provide a rounded view of trials conducted according to different procedures within contrasting legal systems, including English common law and Roman canon law. They consider the judges and juries and the amateur and professional advisers involved in legal processes as well as the offenders brought before the courts, with the reasons for prosecuting them and the defences they put forward. The cases examined range from a fourteenth century cause-célèbre, the attempted trial of Pope Boniface VIII for heresy, to investigations of obscure people for sexual and religious offences in the city states of Geneva and Venice. Technical terms have been cut to a minimum to ensure accessibility and appeal to lawyers, social, political and legal historians, undergraduate and postgraduates as well as general readers interested in the development of the trial through time. Abstract

Plant medicines are the original medicines that humans have always used. Many people continue to use plant medicines today including teas, coffee, chocolate, ginger, and other medicines. Traditional medicine is based on plant medicines and is the primary form of medicine for many people throughout the world. The current volume discusses traditional medicines and presents various plant medicines that could be tested in clinical trials. Modern medicine continues to use many drugs that are derived from plants. The current work has much to teach modern medicine about the treatment of several diseases. Traditional healers have used plant medicines to treat psychiatric and other conditions that modern medicine struggles with. Safety issues are always a concern with plant medicines, especially allergies to plant medicines. Clinical trials must be conducted with plant medicines to help bring these traditional treatments into use by modern medicine.

Abstract

In the last two decades, Indonesia has seen a dramatic proliferation of environmental disputes in a variety of sectors, triggered by intensified deforestation and large scale mining operations in the resource rich outer islands, together with rapid industrialisation in the densely populated inner island of Java. Whilst the emergence of environmental disputes has sometimes attracted political repression, attempts have also been made in recent times to explore more functional approaches to their resolution. The Environmental Management Act of 1997 created a legal framework for the resolution of environmental disputes through both litigation and mediation. This book is the first attempt to analyse the implementation of this framework in detail and to assess the effectiveness of litigation and mediation in resolving environmental disputes in Indonesia. It includes a detailed overview of the environmental legal framework and its interpretation by Indonesian courts in landmark court cases. The book features a number of detailed case studies of both environmental litigation and mediation and considers the legal and non-legal factors that have influenced the success of these approaches to resolving environmental disputes. David Nicholson graduated in Law (Hons) and Asian Studies from Murdoch University in 1995 and was admitted to legal practice in Western Australia in 1997. He subsequently undertook doctoral research on environmental dispute resolution in Indonesia as part of the Indonesia Netherlands Study of Environmental Law and Administration (INSELA) project, based at the Van Vollenhoven Institute at Leiden University, and was awarded a doctorate in law in 2005. Dr Nicholson has since returned to legal practice in Western Australia, specializing in environmental planning and local government law.

Abstract

Several instances of war crimes trials are familiar to all scholars, but in order to advance understanding of the development of international criminal law, it is important to provide a full range of evidence from less-familiar trials. This book therefore provides a comprehensive overview, uncovering and exploring some of the lesser-known war crimes trials that have taken place in a variety of contexts: international and domestic, northern and southern, historic and contemporary. It analyses these trials with a view to recognizing institutional innovations, clarifying doctrinal debates, and identifying their general relevance to contemporary international criminal law. At the same time, the book recognizes international criminal law's history of suppression or sublimation: What stories has the discipline refused to tell? What stories have been displaced by the ones it has told? Has international criminal law's framing or telling of these stories excluded other possibilities? And — perhaps most important of all — how can recovering the lost stories and imagining new narrative forms reconfigure the discipline?

El Diablo entra en el Paraíso, con la intención de apropiarse de la humanidad utilizando un nuevo y formidable instrumento: el proceso. Compuesto en el siglo XIV, transmitido como obra jurídica falsamente atribuida a Bartolo da Sassoferrato, el “Proceso entre el Diablo y la Virgen María” es un proceso simulado, en forma de diálogo, entre el Diablo, Cristo y la Virgen. Considerado como obra menor y casi ignorado por la historiografía, la obra constituye en realidad un extraordinario ejemplo de sincretismo cultural: el lenguaje de la teología sirve al derecho como fuente de legitimación, y a la inversa, la construcción escatológica y la misma teoría de la Salvación se injertan en una estructura jurídica. Desde esta perspectiva, aquí se vuelve a proponer el texto como un punto de observación ideal para aprehender las interacciones de una cultura poliédrica y compleja, suma de teatro y literatura, de derecho y teología, culta y popular.

Abstract

Although mortality rates have declined in recent years, the majority of cancers are still difficult to treat and the medical need for better cancer treatment is evident. The current anticancer armamentarium includes many active agents that are applied across tumor types. However, most of these broadly-active anticancer drugs have a small therapeutic index and barely discriminate between malignant and normal cells. In recent years the focus has shifted to the development of rationally designed, molecularly-targeted therapy for the treatment of a specific cancer, therefore offering the promise of greater specificity coupled with reduced systemic toxicity. NF-kB transcription factor family as emerged as such a promising target for cancer therapy. This Special Issue will explore the routes from NF-kB basic research, cancer research and oncogenomics into the development of NF-kB-based cancer therapeutics and biomarkers.We invite research and review papers in any area of the NF-kB field that are related, but not limited to, fundamental understanding of NF-kB signaling pathways, gene expression profiling, epigenetic regulation, diagnostic, prognostic and pharmacogenomic biomarkers, molecular targets driving the progression of human cancers, cancer drug development on these targets, clinical trial with new agents, and validation in animal models.We hope that this Special Issue reflects the exciting era that we are living in with respect to the field of NF-kB and its applications in cancer research.

Abstract

It has been more than 25 years since the identification of the FMR1 gene and the demonstration of the causative role of CGG-repeat expansion in the disease pathology of fragile X syndrome (FXS), but the underlying mechanisms involved in the expansion mutation and the resulting gene silencing still remain elusive. Our understanding of the pathways impacted by the loss of FMRP function has grown tremendously, and has opened new avenues for targeted treatments for FXS. However, the failure of recent clinical trials that were based on successful preclinical studies using the Fmr1 knockout mouse model has forced the scientific community to revisit clinical trial design and identify objective outcome measures. There has also been a renewed interest in restoring FMR1 gene expression as a possible treatment approach for FXS. This special issue of Brain Sciences highlights the progress that has been made towards understanding the disease mechanisms and how this has informed the development of treatment strategies that are being explored for FXS.

Abstract

The role and value of science within sport increases with ever greater professionalization and commercialization. Scientific and technological innovations are devised to increase performance, ensure greater accuracy of measurement and officiating, reduce risks of harm, enhance spectatorship, and raise revenues. However, such innovations inevitably come up against epistemological and metaphysical problems related to the nature of sport and physical competition. This Special Issue identifies and explores key and contemporary philosophical issues in relation to the science of sport and exercise. It is divided into three sections: 1. Scientific evidence, causation, and sport; 2. Science technology and sport officiating; and 3. Scientific influences on the construction of sport. It brings together scholars working on philosophical problems in sport to examine issues related to the values and assumptions behind sport and exercise science and key problems resulting from these and to provide recommendations for improving its practice.
