Abstract

La historia de la rama iusadministrativa en Cuba no puede contarse bien sin la evocación de los autores que han sustanciado el pensamiento jurídico-administrativo y la literatura especializada en que es vertido parte de ese pensamiento. Si nos remitimos a la etapa en que el régimen jurídico-administrativo moderno comenzaba a echar sus raíces decimonónicas dentro del entramado del Derecho cubano, como consecuencia de la acción del poder colonial español que dominaba a la entonces “siempre fiel Isla de Cuba”. En 1847, el exiguo panorama bibliográfico que tenía lugar en Cuba sobre la temática jurídica, vio incorporarse en él, como nuevo elemento, una obra cuya denominación es Breve tratado de Derecho Administrativo español general del reino y especial de la isla de Cuba, y que tiene por autor a José María Morilla. El hecho de haberse publicado dicho texto marca un punto de significación dentro de la historia del Derecho Administrativo cubano. ¿Cuál es esa significación? ¿Qué características rodean a dicho texto? ¿Qué trascendencia puede acompañarle?

Abstract

The question of how the law can deal with the problem of internet security is addressed in this volume. Starting with the fact that the internet is structurally insecure, the author finds that the uncertainty this causes must be countered with legal means, particularly when it comes to controlling information about weak spots. Hannfried Leisterer’s study examines whether and to what extent information management law can contribute to ensuring internet security.

Abstract

Julian Staben examines chilling effects, framed as deterrence-based lines of argument, in the jurisprudence of the Bundesverfassungsgericht (German Federal Constitutional Court) and compares them with the jurisprudence of the US Supreme Court. Chilling effects follow distinct patterns when it comes to online behaviour and emerging digital practices and therefore call for their constitutional reassessment. Julian Staben's work enables a more methodologically reflective use of these arguments in the judicial discourse.
