Abstract

Copyright law prevents market failure by making intangible goods exclusive and thus marketable. Exclusivity, however, has a downside: If the right holder prohibits uses without making them himself (in a certain way), out-of-print works lie dormant, innovations are hindered, and scientific journals are made prohibitively more expensive. The remedy could be a compulsory copyright licence. This special type of obligation to contract regulated by copyright law – the right holder must grant a licence, but can negotiate the conditions – leads a shadowy existence in literature and legislation. The aim of the work is to close this gap. First, using a comparative law approach and the goal of “normative efficiency”, the author analyses whether and in which cases a compulsory copyright licence should be regulated. He then examines how the compulsory copyright licence could be designed in order to be effective and compatible with international, EU and constitutional law.

Abstract

"Is the copyright law in the information society going to collapse or may a “cultural flatrate” produce relief? In view of the plentiful everyday occurrence of unauthorized and unpaid utilization of digital creative goods, the paper names the deficient situation of German and international copyright law regarding the different interests of copyright holders and users and presents possible perspectives.The legal classification and feasibility of lump-sum payment models that even in the political discussion apply to be an assumedly simple solution of the so-called digital dilemma is surveyed within the work. At the end, an ambitious but non-illusory vision of a European “cultural flatrate” is proposed.Dr. jur. Seyavash Amini has been a scholarship holder of the Max Planck Institute for Innovation and Competition in Munich, he founded the IVOCAT GmbH with focus on Intellectual Property Management in Hanover and works as legal advisor and entrepreneur."

Abstract

Die vorliegende Studie beschäftigt sich mit dem Phänomen aufeinander aufbauenden Werkschaffens und den Herausforderungen, die sich daraus für das Urheberrecht stellen. Die untersuchten Lösungsansätze zeigen auf, wie das Urheberrecht diesen Herausforderungen künftig begegnen und damit insbesondere seiner wirtschaftlichen Funktion gerecht werden sollte.Als möglicher Lösungsansatz wird einerseits die extensive Auslegung vorhandener gesetzlicher Regelungen des schweizerischen Urheberrechts wie die Parodieschranke und die Zitatschranke untersucht. Andererseits werden mögliche Lösungen de lege ferenda skizziert und beurteilt. Dabei steht eine Schranke für kreative Bearbeitungen im Vordergrund; davon abgesehen wird die Einführung einer Schrankengeneralklausel und einer Schranke für nichtkommerzielle Verwendung in das schweizerische Urheberrecht untersucht.This study deals with the phenomenon of derivative works and the challenges it poses to copyright law. The author shows how the law should meet these challenges in the future; in doing so, she takes a close look at the economic function of copyright law.As a first approach, the author examines whether extensive interpretation of existing Swiss copyright limitations, such as the parody exception or the right to cite, leads to feasible solutions. As a second approach, she outlines and assesses possible solutions de lege ferenda. Her focus here lies on a new exception for creative derivatives, a fair use exception and an exception for non-commercial use for Swiss copyright law.

Abstract

Das Werk zieht Bilanz über die bisherigen (Miss-)Erfolge des Einsatzes von Digital-Rights-Management-Systemen bei der Online-Vermarktung von urheberrechtlich geschützten Multimediawerken. Weiterhin wird ein neuer Ansatz zum Schutz solcher Werke im Web 2.0 in Form von Filtertechnologien, die digitalisierte geschützte Inhalte identifizieren können, vorgestellt. In rechtlicher Hinsicht wird geprüft, wie sich der Einsatz solcher Technologien durch Betreiber von Social-Media-Diensten auf deren urheberrechtliche Haftung auswirkt, vor allem im Hinblick auf die Haftungsbeschränkungen nach dem TMG und nach dem US-amerikanischen Digital Millennium Copyright Act, die einer rechtsvergleichenden Analyse unterzogen werden.

Abstract

"The thesis examines the international and European regulations of the exceptions and limitations of copyright law and points out the leeway member states have for implementing them. The thesis analyzes solely the legal consequences of these exceptions and limitations in regard to contractual agreements. It outlines the structural concepts in InfoSocRL, UrhG, German civil law, and the law of collecting societies, and takes into account constitutional rights (GG, GRCh). The thesis also deals with the current discussion on the participation of publishers in these remuneration rights of authors.The work is aimed at authors, publishers, and collecting societies."

Abstract

Subject of this thesis is the Scandinavian ""extended collective licensing"" model (""ECL""), which allows the licensing of entire repertoires of copyrighted works to users through the extension of collective agreements to outsiders. Despite its growing popularity the extended collective license has not yet been scientifically examined in a satisfactory and exhaustive way. Against this background, based on a comprehensive analysis the nature, the structure and the relevant aspects of this legal concept are explored in more detail. Based on these findings the work centres on the question of whether and to what extent the extended collective license could be utilized as a possible solution in Germany and Europe in the near future. Just at the interface of exclusivity and collectivization the Nordic model might ensure the balance of interests in certain areas in copyright law.

Abstract

"This publication provides a view beyond the big European ­collective management organisations (CMOs) and contributes to the transparency of the collective rights management ­systems of young and prospective EU-Member States. Since the accession of Slovenia and Bulgaria, the territory of EU expands over the region of South-Eastern Europe (SEE). ­Nevertheless, the EU academic circles are generally unfamiliar with the field of collective management of copyright and related rights in SEE. However, in the last twenty years, a diverse and to an extent rather specific landscape of CMOs has been ­developed in that region. The legal framework and the ­particularities of the latter are worthy of scientific consideration.This book also deals with the position of those CMOs from the region with regard to the increasingly strong requirement for cross-border licensing in the online field and the tendency for more competition between CMOs."
